Ur.c. 13 ?Trial oj John HcKiunry /or receiving Stolt* Good?.- '1 hie man, who keepe a junk shop at the corner of Juim a and Madbon etreete, was put upon his trial on a charge of receiving a quantity of stolen composition knobs taken hum the iron railings ot houses in Market, Oliver, and other slretts, in Jun- lust, by a gang ol thieving ho) s, he know ing them to be stolen when he made the purchase. The prosecution proved by Jacob'I'. Merrill, of n Mark-1 stre-t, toat a number of composition knobs w i re btoki n iuim lhe railing in front ol bin bouse in the month of June or July last. They weighed from u ha'l to ii |a>uiiil a-piece, and wcie worth about thieu shillings pet pound. Wm. B-cchley, one of the city marslialf, at the time arrested a nnmtsei of boys who had stoleu the knobs, nut found none on McKinney's premises. Chart's WaUon, a laiy atiout 14 yeats ol age, who was hiought from the House ot Retuge, where lie was oemo-iuesl .me lour tuonths -nice lor being with two boys when they stole a dollar, was then called as a witness, lie testified that he had been present when composition knobs ware broken from the iion tailings in Ironl ot housts in Madison anil Maiket streets, and from ihu comer of Cast Broadway and Rutgers street, by boys named Hugh Bog an, Thomas Lawler. Dennis Morrison and others. He was alao with these boys when they took a quantity of knob* to the junk shop of McKinney, where a man weighed them, and McKinney paid them at the rate of eight cents per ]iounJ. Witness tolu McKinney that tha boys bed stolen them and that they were broken off from iron railings, when he kicked at him, but witness jumped out of the way. This tioy was most closely cross-examined by N. BJJcuiit, Esq., hut told a very straight story throughout. N. B. Bi cut. Esq fordelence, stated, on opening, that he wished to call the attention efthnCourt to the tart, that the property stolen was not personal property, hut belonged to the freehold, and tlx refine .the indictment should have been for malicious tresspass and, not lor receiving stolen goods. He then read the statute of the state relative to trespass upon real estate, in w hich the law makes a distinction between the ottence of severing and taking any thing appertaining to a freehold under JcJ5, and an amount above that sum. the first beins considered n mall cioua trespass only, and tbe second a larceny. The District Atto?wit called the boy Watson again, who deposed that tbe composition top* were broken off by a wrench by Hugh Bogan, and then banded to another hoy, who put them in hit pocket?that in no instance did any of them (all upon tha groitnl, ai the wrench held them last. The Duraicr Attorssv in reply to defence, contended that the instant the property was severed it became net* sonal property That the act was not one continued act on the part of the trespasser, as after he had broken oft the knobs he handed them to another toy, which loss of continued possession made them both liable. '1 hat having departed with such possession for sn instant, at'he time of the trespass a larceny whs then created. Judge Ltisch asked the District Attorney how a trans fer could be made from one paity to another when such parties are jointly concerned in the trespass 7 James M. Brsdt, Esq. for defence, took the same view with bis associate. The Conkt decided that the lrrjal position of Counsel for defence was correct, as the lew was express that the severing of an> thing from n freehold under the value of $4A was not a larceny, but malicious trespass. That the transferring of the property thus severed Irom the hands of ono of the parties to the pockets of another w as no more of an ollence than if he had put it in h<s own pocke', and was not a larceny in the eye of the law. Tbe Cuurt saidthat although this allowed a great license forthieves, yet it was the law, and as such the Court were bound to charge the jury. The defence offered no evidence, and the Recorder proceeded to charge the Jury to the above effect, concluding with the rrmark that if they were satisfied that the act of taking the articles alleged to nave been stolen, was a continuous act, th< n the crime w.-ta not a larceny, and therefore the accused was not guilty ef thaotfenre alleged against him, as the articles were not stolen. But if they believed the reverse, they were bound to bring in contrary verdict. Tbe Jury, alter a short absence, returned into Court, and rendered a verdirt of guilty. Mr. Blcist then moved the Court for an aiTest of judg. meat, which was granted, and the esse will heaigu-d on the point ol lew as charged by the flourt, the Je enco contending that the def-mlnut wna entitled to a discharge tinder the law netting u|ioti the case. Mr. Jack'on, pawnbroker, ol the Bowery, teetiflrri that Morton came to bia store and otr.Teil to sell a quantity of knives. which he confessed had bean stolen. The defence proved by two witnesses that while standin* at the cornarof Elm and Anthony straits, about tha middle of fteptemher, they heard some one ask Morton if he would btiy some knives which had been smuggled, as they would he sold rbrap. Thacase was summed up fordelence by Thomas Pheni*. I'q and the District Attorney for prosecution. The Clay and Van Bureu parties are making additional demonstrations of alarm, on account ol the appearance of the new candidate, though great efforts are made by a few of the most sagacious among them to keep quiet. Yesterday the "Courier and Enquirer" came out with an article quite laudatory of General Cass, but stating that he could never be a candidate with any chance of success until alter Henry Clay hud occupied the presidential chair. From this is it evident that the ultras both purtiau an- determined 10 crowd (leneritl t'iisa out of the field; and it is possible that they may endeavor to prevent the masses from coining up so rapidly to his support, as their enthusiasm would impel them. 1'ut there can. alter all, be but httl doubt that throughout the interior of the country, and among the great classes to whose resj>ect j and good will the popular conduct, talents and patriotism, of General Cass, appeal so forcibly, his name will be taken up, and that he will be pressed forward with all that spirit and energy which his cause naturally excites. Perhaps the gallant Colonel, late escaped from the state prison, may have some feelings of consanguinity, seeing that a full report of his own schedule has not yet been given. Really, really, nothing seems to have any eflect on the sense, tact, sir judgment of Webb. Hut the leading members of"the opposite parly, although they are opposed to monopolies, yet they dare not oppose ninety per cent of good democratic butchers. Look at the facts of the case on Monday evening. It will be seen, in our report of the meeting of the Board of Aldermen, in yesterday's paper, that the question of licensing these shops was taken up for final action, and lost by a vote of ten to five, two Aldermen being absent. The friends of the new ordinance, who came up boldly and promptly, and without any backing, or filling, or dodging, were Alderman Jones of the Fifth Ward, Underwood of the Third, Woodhull of the Second, Smith and i Bunnell. The first three named supported their votes with very able arguments and much zeal. On the other side, the opponents of the same measure were, first and foremost, Alderman Leonard of the Ninth Ward, Aldermen Lee, Purdy and West, who took an active part in the opposition; Aldermen Oedney, Balis. Martin, Hatfieid, Davies and Croliua. It was not a strict party question, although the leading friends of the meat shops were whigs, and the leading opponents were democrats. Alderman Leonard of the Ninth would strike out the monopoly features of the meat laws, but would still confine all sales of meat to the regular public markets. Alderman Woodhull will vote for licensing the meat shops, provided none but butchers be licensed as the city charter gives no power to regulate any other business than that ol butchers, therefore the Board would have no power over other persons than butchers. As to the practical force, virtue, and etfect of the ordinance passed by the Board of Aldermen, on Monday evening, it is a perfect nullity. It leaves every thing just where it was before. It makes the condition of neither butchers nor meat shops either better or worse than it was before. The ordinance was taken up in the Board of Assistants last evening and ordered to be printed. It is to be the special order of the meeting next Tuesday evening, when it will receive a severe overhauling. Bankruptcies, as illustrative of the Social uontmtion.?Jn tne city ot New YorK there are probably about two thousand applicants for the benefit f the bankrupt law. The schedules, containing the necessary description of the affairs of these individuals, are about ten thousand in number, and form a library of the most remarkable and instructive character. In fact, no collection of tomes in the known world, from that in the Vatican to the Bodleian Library, could compete with this extraordinary assemblage of manuscripts, in point of that matterof-lact interest which comes home to the bosom and business of every man. In these documents we are presented with a per'ect picture?drawn with all the stern fidelity of legal accuracy and precision?of the actual condition of society, the errors, follies, vices, and indiscretions of men?the course and progress of finance, morals and religion. It is indeed difficult to describe the full interest and importance of these most curious of all auto-biogra1 ?l.'. iitl.s u -i 1 1 1'iiics. v? urn a wunu im sagacious speculation, ana sober reasoning, and painful moralizing, and philosophic reflection, is opened up to the thoughtfnl reader of one of these magic volumes The whole history of a man's career, with all its bounding hopes, its disappointments, its hypocrisies, its shifting*, its doublings to escape the dreaded exposure, its positive frauds?all this condensed into the formal record of a legal document In olden times the had their illuminated manuscripts, and with wonderfully graphic power did the artist often unfold and illustrate the story but the plain, familiar, and unpicturesipie memorials which occupy such conspicuous place in the bankrupt's schedule, have more significant expression than all the cunningly devised works of monkish illuminators They are the most intelligible of all marginal references. They do, indeed, expound faithfully the meaning of the text. And the text itself is written wi'h admirable simplicity. We understand it at first sight. It is the story of a life in one brief chapter. Take up volume after volume of this extraordinary library, and we read the same history of a man starting in life, with perhaps good principles, but rapidly becoming involved in the meshes of ill fortune, in consequence of adopting false and ruinous notions of business, finance, and domestic economy. He then resorts to one trick and contrivance after another, in order to keep up appearances, and eke out a brief existence of outward show. We can thus trace the whole downward career, until it ends in open bankruptcy. No doubt many individuals have been ruined without ?,,;i>.. -.r ?i:.? ?i u Arrival ok t:ik C )L"k?u it Hi >>t fiiiis i.The frigate Columbia, Captain Shubrick, hasarrived safely at Rio de Jaiitero. J While we were on eur passage here from Portau Prnva. a very aospiciou8 looking bngantine overhauled ua very last, passed within a cable's length of us, and went right to windward of ua, going dead in the wind's eye, only asking ua our latstude. We could see holes cut for aweejw in her bulwarks, and she had 18 or 20 men on her deck. Before our captain could make up his mind to overhaul her, she was half a mile to windward of ua. We cracked on all sail and stood after her; but night coming on we lost her. Well, on coming in here, the first cratt that attracted our attention was this very vessel, that had been taken afterwurds by an English sloop of war. She proved to have 300 slaves in her hold. She was sold for $11,000. We are now painting the vessel throughout, and ns soon as finished, which we ex|iect will be in ten days, we are to proceed to Montevideo in company with the whole squadron, there to demand, for the third time, some money due American residents for property destroyed by mobs incident to the war going on there. If the money is withheld this lime, serious consequences will ensue. Fkom Brazil.?We have just received the following letter from Rio de Janeiro. It came by the Isabella, which arrived last Sunday. Where it has been since then is more than we can tell. Last Monday we gave news from Brizil to the 27th of October, which we translated from the Jornol do Coinmercio. No other paper in this city had a syllable. On Tuesday, however, they came out with some, which the captain of the Isabella pronounces incorrect from the beginning to the end. That which we published was the only correct intelligence from the South American empire. Itio dk .Janeiro, Oct. 26,1842 *amks Gordon Bennett, Esq.? About half past six o'clock this moming, a fire eas discovered in a tailor's shop on the corner of Exchange alley and Pratt street, and so rapid was ts progress that it consumed four large warehouses tefore it wassubdued. The fire was first discover d by Mr. Samuel Sindale, a young man in the em>loy of Davey Smull, whose shop is adjoining the ire. Sindale immediately broke open the door, and n doing this he awoke Mr. John Moody, tobaccolist, who lived in 'he same house. Mr. Moody had lardly time to rescue his wife and children, by neans of a ladder, before his house was entirely in lames. As for himself, he did not save even a coat. The next house to this was occupied by Mr. Gillett is a tea warehouse. This house was very much inured by the fire, but a large quantity of tea was re noved in time to save it. The next house to this is ?n the corner of Gay and Pratt streets, and is occuiied by Mr. Fenby as a feed and general produce itore. This house most luckily, was not injured n the least by the fire, and (he damage by vateris very trifling. The fire there changed its :eurse up Gay street, and destroyed a three atory varehouse occupied by Hugh Boyle, and the next louse above, occupied by Thomas Wilson. Mr. Vnby's store was between the fire on both streets, ind escaped unscathed. The loss ol Mr. Moody is robably the greatest; he had $3500 insurance on lis stock in the Merchants', ana his furniture was nsured in the Firemen's. Most of the houses and [ooifs injured were insured to some amount, but not efficient to cover the whole loss. Our firemen did heir best to subdue the flames, but we think they :aine with rather less speed than they generally do. There is nothing stirring in Baltimore in the way if incident or business. A great many of our citi:ens have walked out to see the fire, which is alvavs the case here after a large one.
