Notwithstanding the intense cold and seventy of the weather ihts moraine, there was a great crowd around the iron gates and the back entrance ot the City Hall, as early as nine o'clock; and a large number of persons were waiting inside, although thev knew that they could not obtain admittance. Tke Court Room was Ailed as toon aa the doors were opened j and among the audience were five females of respectable appearance, sitting immediately behind Colt. The prtaoner was employed in reading and writing till ten o'cloek; ke looked rather hagard and care-worn, and bad avidently suffered intense mental anguish during the last few days. The District Attorney was not present at the opening, but came in a few minutes. Mr Selden was engaged in the Court of Chancery till eleven o'clock. The first witness called, was? Wiiitino then read a note by Cowan, page 345, stm 4X1 anil 41V and nnts 447. He said these were all the authorities he should five now on the subject: if 1 wish to show au act, which I can do, the declaration of Adams was a part of the act, as to why he did not give a proof to Johnson. The CocaT read from Archibald's criminal pleadings as to hearsay evidence, that conld not be admitted, and hearsay that could be admitted txnettstit ait- If Mr Whiting could bring this declaration within the rule, among those exceptions mentioned try Archibald, as qualifying the act itself it would be admissible. The cry of the msb in Lord George Gordon's case was admitted as qualifying theiracta at the time. If Mr. Adams said where he was going, or that he was going to see Colt, that might be admissible. I believe he's in the H'est India Islands otpresent. I think he left here about the middle of November. I made a small mm k on it, by opening it with my knife. Judge Ke.it show that to the j'ury, sir. 'J he watch was then shown to the j >rj. Uross-txamined? Don't recollect precise tim when this sale was made by Ransom to Adams.? Mr. Adams he-lit a note agtinst Mr Rawson. 1 took up the note by giving ifcut watch in payment to Mr. Adams ibr >ugK Mr Ransom. We were all three present on that occasion Adams required payment m uiai utnrui various nines 11 was mine n-ighb >rhood of $11 1. Me and Mr. Kawsoit had our ullicu at the same place I received the note of RuniOiii as a substitute lor the watch. There was a bilauee?don't know whether 1 took possession of the note then or not. 1 gave iny due bill to Sir. Adams in payment lor the b jance, payable in goods, and 1 became the holder of the claim against K.ihsera. 1 think the bulance waa between 2b and $27 I looked to Rausom for payment of the note. Air. Adaina naW he was satisfied with the watch and my due bill. That note of $111, was a note given for a renewal of another note which had been part paid T.ie note was only a short time past due.? Adams had been down there >vo or three times to claim payment of that note. At one time when he called 1 heard Mr. A lams? Stopped by the DisTMCT-ArroRjrs.v, who objected to it. CociT? l'he bargain for the watch is part of the re* jeala. Selden asked the witness what was the state of feeliug exhibited by Mr. Adams, when he came there to demaad pay meat for that note. Whiting objected. Selden said it was not the object of the defence to go into the general character of Adaina' mind, but to show what was the ordinary conduct of Adams when he called on individuals for money, to demand p iyment, and did not get it That he was in the habit of exhibiting a harshness and irritability of temper and language on such occasions; and they wi.-bed to show what was his conduct, lauguage and temper on that occasion. VViiiTiNG had ao objection to go into the general character of his temper, bnt he objected to going into any specific act of Mr. Adams. Selden did not wish to go ino general character, but to show that Adams was in the habit of using sovere and unkind language, to say the least of it, towards bis debtors aboet that time, when be called on them fur money, end did nat get it. A I specific aei of outbreak of temper, under circnms ances similar t whit will, 1 believe, he pre anted in this cans*-, will ha testimony to go to this jury, that Adams might have had a similar outbreak onigoidg to a pcrso i immcdately subsequently to this transaction of tnc note and watch; and if it is pro red that Adams e tiled on Colt two weeks after this to demand money, may not this previous fact of his exhibition of p?S;iun aud temper go far to iliowwho was likr ly to cxnibit the first outbreak of temper that led ou to th s unfortunate rencontre. With regird to general temper, men of education, ia their general walk through life are taught to control their passions, and do so coutroltht m generally in their daily intercourse, and yet may exhibit the most violent passions when brought iulo contact with others in a different walk ol life?a laboring man, and so on, and his pmssians break out, and show the man with all ihc turbulence and violence 01 dispositi n with which the Cod of Nature made hiin. The inquuiry in this ease then must be spacific, and can never be general. The learned counsel m >at eloquently concluded by saying that he ceuld net and would not lacerate the feelings of Mr. Adams's friends; it was not the wish of hit client, and he would not do it, if he eould, by endeavoring to show that the general temper of Mr. Adams was violeutaud passionate?but he had the right to go iuto speciCc aets of his temper, exhibiting passionate outbreaks, when he called for money and did not get it. This was their legal right, and he would go no further, even if driven by any rule of law to such a course. The Court said that the point seemed after all to be what was the temper and conduct and language of Mr. Adams on tbis oocasion, or on the occasion of asking for money and not getting it. The temper of the individual can be shown. The question therefore may be asked. WHtTin objected. W|T.?Ess?A"liins had been to onr office before to get the money for this note; he told Mr. Ransom that he believed fir meant to nrindle him out of the iteht. lie seemed to be angry. Judok K.?
