There is alittle hubbubin the office of the clerk of the Court of Appeals. On the death of Josiah Thornburgh, Mr. Joseph J. Baler, the Chiet Deputy, was promoted by the Judges of the appellate courtto the position made va- cant by the demise of Mr. Thornburgh, in prefer- ence to some score of outside candidates for the clerkship. This wasconstrued as civil service reform and the correct thing forthe Judges to do inasmuch as they rewarded merit and service. Ofcourse it was thought that Mr. Baier, hav.ne¢ received his appointment in the regular way of promot:on, would carry out the 2 set bim by the Judges. Theretore Mr. W. H. Gray, an efficient and popular clerk with st bar,and nextin rank to Mr. Baier,it was anticipated, would be promoted to the chief clerkship. But Mr. Baier, having obtained his po- sition as clerk ,seems to have gone back upon the good precedent set by the Judges. He intends, it is said, to bring in an outsider and give him the position of Chiet Clerk. This ot course has occasioned an amount of kicking amongst the otber clerks, and especially among the friends of Mr. Gray, who claim that he is enti- tled to the position, and that the Judges ex- pected Mr. Baier would follow out the rule of promotion, as they had done in his case. How the matter will end it isnot Known, but un less Mr. Baier reconsiders his determination it is said that a strong fight will be made against bim when his name comes up tor contirmation atthe October teria.
