[0:10] SPEAKER_00: Yesterday,
[0:11] SPEAKER_00: by a vote of 5-4,
[0:13] SPEAKER_00: the United States Supreme Court allowed Trump to continue to build his ballroom.
[0:18] SPEAKER_00: The five right-wing justices concluded that the National Trust
[0:22] SPEAKER_00: for Historic Preservation,
[0:24] SPEAKER_00: which had sued to stop the construction of the ballroom,
[0:27] SPEAKER_00: did not have legal standing to sue,
[0:30] SPEAKER_00: and that national security considerations came down on the side of construction.
[0:36] SPEAKER_00: The majority said it was not resolving the issue of whether the project is legal.
[0:42] SPEAKER_00: It was Chief Justice John Roberts who covered that aspect of the controversy.
[0:47] SPEAKER_00: He wrote in dissent that the project is likely unlawful.
[0:53] SPEAKER_00: The White House is an iconic American building whose symbolism
[0:56] SPEAKER_00: and history are wrapped up in its architecture, Roberts wrote.
[1:01] SPEAKER_00: He wrote that it is critical to ensure that those responsible follow the rules
[1:06] SPEAKER_00: in deciding what to tear down and what to build up at the People's House.
[1:12] SPEAKER_00: Nonetheless,
[1:13] SPEAKER_00: as Josh Gerstein of Politico reported,
[1:15] SPEAKER_00: the project will likely be completed before the question
[1:19] SPEAKER_00: of its legality is resolved.
[1:22] SPEAKER_00: Trump's behavior in his second term is a logical outcome of the theory of
[1:27] SPEAKER_00: the unitary executive.
[1:29] SPEAKER_00: Under President Ronald Reagan in the 1980s,
[1:32] SPEAKER_00: those eager to stop Congress from passing legislation that benefited
[1:36] SPEAKER_00: the American people at the expense of businessmen began to argue for the idea that
[1:42] SPEAKER_00: because the president was head of one of the three branches of the U.S.
[1:45] SPEAKER_00: government,
[1:46] SPEAKER_00: he could not be checked by either of the other two branches,
[1:50] SPEAKER_00: the legislative branch, Congress, or the judicial branch, the courts.
[1:56] SPEAKER_00: On July 1st, 2024,
[1:58] SPEAKER_00: the United States Supreme Court,
[2:00] SPEAKER_00: stacked with Trump's appointees,
[2:02] SPEAKER_00: took this theory to a conclusion that overturned the central premise
[2:06] SPEAKER_00: of American democracy, that no one is above the law.
[2:12] SPEAKER_00: It decided that the President of the United States has absolute immunity
[2:17] SPEAKER_00: from criminal prosecution for crimes committed as part of the official acts at
[2:21] SPEAKER_00: the core of presidential powers.
[2:24] SPEAKER_00: The court also said it should be presumed that the President also has immunity
[2:29] SPEAKER_00: for other official acts as well,
[2:31] SPEAKER_00: unless that prosecution would not intrude on the authority of the executive branch.
[2:38] SPEAKER_00: Writing for the majority,
[2:39] SPEAKER_00: Chief Justice Roberts said that a president needs such immunity to make sure
[2:44] SPEAKER_00: the president is willing to take bold and unhesitating action
[2:48] SPEAKER_00: and make unpopular decisions,
[2:51] SPEAKER_00: although no previous president ever asserted that he was above the law or
[2:55] SPEAKER_00: that he needed such immunity to fill his role.
[2:58] SPEAKER_00: Roberts' decision didn't focus at all on the interest of the American people
[3:04] SPEAKER_00: in guaranteeing that presidents carry out their duties within the guardrails of
[3:08] SPEAKER_00: the law.
[3:10] SPEAKER_00: This permission structure appears
[3:12] SPEAKER_00: to have convinced Trump he can do whatever he wishes,
[3:15] SPEAKER_00: including rigging elections so he cannot lose.
[3:20] SPEAKER_00: Yesterday,
[3:20] SPEAKER_00: Senator Richard Blumenthal,
[3:22] SPEAKER_00: a Democrat of Connecticut,
[3:24] SPEAKER_00: of the Senate Committee on Homeland Security and Governmental Affairs,
[3:28] SPEAKER_00: who is the top-ranking Democrat on the permanent Subcommittee on Investigations,
[3:34] SPEAKER_00: exposed what appears to be a plot to steal the 2026 midterm elections.
[3:40] SPEAKER_00: Blumenthal released a letter he had written
[3:42] SPEAKER_00: to Postmaster General David Steiner calling attention to
[3:45] SPEAKER_00: an official whistleblower report, which he attached to the letter.
[3:51] SPEAKER_00: It's eye-popping.
[3:53] SPEAKER_00: The whistleblower warns that there are potentially catastrophic problems in
[3:59] SPEAKER_00: the development of the United States Postal Service's new system
[4:03] SPEAKER_00: for handling federal election ballot mail.
[4:07] SPEAKER_00: According to the whistleblower,
[4:08] SPEAKER_00: the process for the creation and implementation of an entirely new and untested set
[4:15] SPEAKER_00: of IT systems for delivering ballots to voters for
[4:19] SPEAKER_00: the midterm election has been secretive, rushed, chaotic, and fundamentally flawed.
[4:27] SPEAKER_00: The whistleblower says the administration has hidden the high likelihood that
[4:33] SPEAKER_00: the new ballot mail verification processes will result in major disruptions
[4:40] SPEAKER_00: in mail ballots ever getting delivered to voters.
[4:44] SPEAKER_00: As presently designed,
[4:46] SPEAKER_00: if even one barcode on one single ballot in a bulk mailing of 10,000 ballots fails
[4:54] SPEAKER_00: to properly scan during the verification process,
[4:58] SPEAKER_00: the entire batch is rejected and sent back to the state,
[5:03] SPEAKER_00: effectively stopping the ballots from being mailed to voters.
[5:08] SPEAKER_00: The complaint continues.
[5:10] SPEAKER_00: Even under ordinary circumstances,
[5:12] SPEAKER_00: this would be problematic because of predictable errors
[5:15] SPEAKER_00: in any barcode scanning process.
[5:18] SPEAKER_00: But the rushed IT development of
[5:20] SPEAKER_00: the new system means it will almost certainly have significant operating problems
[5:26] SPEAKER_00: when released to the public.
[5:29] SPEAKER_00: The whistleblower notes that multiple officials from
[5:32] SPEAKER_00: the United States Postal Service have described the development process for
[5:36] SPEAKER_00: the system as a sh** show.
[5:40] SPEAKER_00: The whistleblower said that work on
[5:43] SPEAKER_00: the United States Postal Service election ballot mail IT project began in June 2026
[5:50] SPEAKER_00: and has continued despite an injunction from a federal court ordering work on it
[5:56] SPEAKER_00: to stop.
[5:58] SPEAKER_00: Normally,
[5:58] SPEAKER_00: it would take nine months to a year or more to roll out a project
[6:03] SPEAKER_00: of this complexity, magnitude, and importance.
[6:07] SPEAKER_00: Considering the rush and the consequences,
[6:10] SPEAKER_00: the whistleblower wondered whether catastrophic failure would be a feature rather
[6:16] SPEAKER_00: than a bug.
[6:18] SPEAKER_00: The complaint says the apparently sloppy and rushed manner in which
[6:23] SPEAKER_00: the federal ballot mail portal
[6:25] SPEAKER_00: and supporting IT systems are being built poses significant risk.
[6:31] SPEAKER_00: Potentially millions
[6:33] SPEAKER_00: of American voters may not receive their mail-in ballot this election cycle in
[6:39] SPEAKER_00: a timely manner or at all.
[6:43] SPEAKER_00: Blumenthal noted that the United States Postal Service has a restrained role as a mail carrier.
[6:50] SPEAKER_00: It has never before played a gatekeeping function and yet is now building
[6:55] SPEAKER_00: an entirely new system to put itself in a position to refuse to mail ballots
[7:02] SPEAKER_00: that state election officials have determined should be sent out.
[7:07] SPEAKER_00: He called for Postmaster General Steiner to abandon this ill-conceived,
[7:13] SPEAKER_00: unconscionable plan and ensure
[7:15] SPEAKER_00: that all Americans can exercise their constitutional right to vote,
[7:20] SPEAKER_00: including by mail, without interference by the United States Postal Service.
[7:27] SPEAKER_00: Blumenthal demanded Steiner answer no later than Friday whether
[7:32] SPEAKER_00: the United States Postal Service has stopped work on the project as ordered by
[7:37] SPEAKER_00: the courts,
[7:38] SPEAKER_00: as well as provide the names of those who worked on the project and
[7:41] SPEAKER_00: the dates they were active.
[7:44] SPEAKER_00: By September 8th, he wants to see all records about the project.
[7:49] SPEAKER_00: Blumenthal told reporters,
[7:51] SPEAKER_00: the main takeaway for me is that the Postal Service has designed a system
[7:56] SPEAKER_00: to disenfranchise millions of Americans.
[8:00] SPEAKER_00: One-third of all Americans cast their ballots by mail,
[8:05] SPEAKER_00: and the United States Postal Service puts all of their votes at risk.
[8:11] SPEAKER_00: The administration's attack on elections is especially concerning,
[8:15] SPEAKER_00: considering the recent suggestions that Trump is spending most of his time
[8:19] SPEAKER_00: on his legacy projects like the ballroom,
[8:22] SPEAKER_00: leaving him largely unaware of what is going on in the administration.
[8:27] SPEAKER_00: Nancy A.
[8:28] SPEAKER_00: Youssef,
[8:29] SPEAKER_00: Misty Ryan,
[8:29] SPEAKER_00: and Michael Schur of The Atlantic reported yesterday that
[8:33] SPEAKER_00: when Army Secretary Dan Driscoll went directly to Trump with his concerns
[8:39] SPEAKER_00: about what Hegseth is doing to the Army,
[8:41] SPEAKER_00: Trump was surprised to learn how many generals
[8:45] SPEAKER_00: and other top officers had been fired,
[8:48] SPEAKER_00: pushed out,
[8:48] SPEAKER_00: or passed over for promotion under Hegseth and expressed concern about the deep cuts
[8:55] SPEAKER_00: to the Army's senior leadership.
[8:58] SPEAKER_00: Driscoll resigned yesterday.
[9:02] SPEAKER_00: As for the plan to sabotage mail-in voting,
[9:05] SPEAKER_00: Representative Joe Morales,
[9:07] SPEAKER_00: a Democrat of New York,
[9:08] SPEAKER_00: the top-ranking Democrat on the House Committee on House Administration,
[9:13] SPEAKER_00: which oversees the administration of federal elections, posted,
[9:17] SPEAKER_00: "...these whistleblower allegations are extraordinary."
[9:23] SPEAKER_00: If Trump administration officials knowingly built a system designed
[9:28] SPEAKER_00: to prevent Americans from receiving their ballots, that is not election security.
[9:34] SPEAKER_00: It is a betrayal of our Constitution and the American people.
[9:44] SPEAKER_01: Letters from an American was written and read by Heather Cox Richardson.
[9:49] SPEAKER_01: It was produced at Soundscape Productions,
[9:51] SPEAKER_01: Dedham, Massachusetts, recorded with music composed by Michael Moss.
