[0:01] Speaker 1: Hi guys, welcome to Till Death Do Us Part. I
[0:05] Speaker 1: will be your host today, Emily Simpson with Shane. So
[0:08] Speaker 1: for today's case, we are going to talk about a
[0:10] Speaker 1: man named Lee Gilley. It's been out there in the
[0:12] Speaker 1: news a little bit, but have you heard of him?
[0:14] Speaker 2: No.
[0:15] Speaker 1: All right, so let's get into it. In October of 2024,
[0:19] Speaker 1: Krista Bauer Gilley, a 38-year-old Houston physical therapist and mother
[0:24] Speaker 1: of two with another baby on the way, was found
[0:27] Speaker 1: unresponsive in her home in Harris County, Texas. Her husband,
[0:31] Speaker 1: Lee Gilley, called 911, but what began as a reported
[0:35] Speaker 1: medical emergency soon became a homicide investigation. Lee was charged
[0:40] Speaker 1: with capital murder and the deaths of his wife and
[0:43] Speaker 1: their unborn child. He has pleaded not guilty. Then just
[0:47] Speaker 1: weeks before his trial was supposed to begin, the case
[0:50] Speaker 1: took a dramatic turn that sent it across the Atlantic,
[0:54] Speaker 1: where it remains tangled in an international legal fight. Do
[0:58] Speaker 1: you know where Lee Gilley is right now?
[0:59] Speaker 2: Is that the one where he's in Italy?
[1:01] Speaker 1: Yeah, he's in Italy.
[1:03] Speaker 2: Yeah.
[1:04] Speaker 1: It's very interesting to me how this man is arrested
[1:07] Speaker 1: for murder.
[1:09] Speaker 2: And then he goes on vacation in Italy.
[1:10] Speaker 1: And then he's like in Milan. It's crazy.
[1:13] Speaker 2: He's having the best of pastas and pizzas and entertainment.
[1:17] Speaker 1: Well, he's in prison in Italy right now.
[1:19] Speaker 2: Well, he probably still is having pasta and pizza.
[1:22] Speaker 1: All right. So Krista and Lee Gilley both attended Clemson University,
[1:28] Speaker 1: and this is where they first met. They went on
[1:30] Speaker 1: one date and then reconnected eight years later.
[1:33] Speaker 2: They had a second date eight years later? Yeah.
[1:35] Speaker 1: The first one must not have gone very well. She's like,
[1:38] Speaker 1: he gives murder vibes.
[1:41] Speaker 2: Then she forgot about the murder vibes.
[1:42] Speaker 1: She's like, oh, wait.
[1:43] Speaker 2: He probably grew out of it.
[1:44] Speaker 1: Yeah, he was young. A Charleston wedding magazine post said
[1:48] Speaker 1: that the second date took place in Boston. Lee graduated
[1:52] Speaker 1: from Clemson in 2008 with a bachelor's in mechanical engineering.
[1:58] Speaker 1: All right, then they married on January 28th, 2017 in Charleston,
[2:02] Speaker 1: South Carolina. Krista is from Charleston and her family moved
[2:07] Speaker 1: from Pennsylvania to Somerville, South Carolina when she was in
[2:10] Speaker 1: middle school. Later, the couple settled together in Houston. So
[2:15] Speaker 1: now they're in Texas. Okay. And they had two children
[2:19] Speaker 1: born in 2020 and 2022. So they have young children.
[2:24] Speaker 1: Acquaintances described them as a very happy couple. One Houston
[2:28] Speaker 1: acquaintance told People Magazine that they had seemed like the
[2:31] Speaker 1: happiest couple in the world.
[2:33] Speaker 2: That's what they all say.
[2:34] Speaker 1: I know, right?
[2:35] Speaker 2: Because you don't really know your neighbors.
[2:36] Speaker 1: It's really the unhappy couples that are just the solid ones.
[2:40] Speaker 2: No one's ever going to say, oh, yeah, I'm not surprised.
[2:43] Speaker 2: I knew he was going to kill them. Like, no
[2:45] Speaker 2: one says that about your neighbors. Probably because- If anyone
[2:48] Speaker 2: asked you about your neighbors, what would you say?
[2:50] Speaker 1: About my neighbors?
[2:50] Speaker 2: Yeah.
[2:51] Speaker 1: I don't know who my neighbors are.
[2:52] Speaker 2: Well, what would you say?
[2:53] Speaker 1: I don't know my neighbors.
[2:54] Speaker 2: Oh, they're kind of quiet. They kind of kept to themselves.
[2:57] Speaker 2: They seem nice. That's all he would say.
[2:59] Speaker 1: Well, people describe them as the happiest couple they've ever
[3:02] Speaker 1: met in the world.
[3:03] Speaker 2: Wow.
[3:04] Speaker 1: Krista worked as a physical therapist and also served as
[3:07] Speaker 1: an adjunct professor at the University of Texas Medical Branch
[3:11] Speaker 1: and the University of Pittsburgh. Lee worked as a software consultant. Um,
[3:16] Speaker 1: prosecutors say, so now we get to March 18th of 2024.
[3:20] Speaker 1: This is roughly seven months before Krista's death. Prosecutors say
[3:25] Speaker 1: that Lee wrote a Reddit post that month saying he
[3:28] Speaker 1: was bored in his marriage and looking for a casual
[3:31] Speaker 1: arrangement with a college aged woman for a friends with
[3:34] Speaker 1: benefits arrangement. Who does that?
[3:37] Speaker 2: He does.
[3:38] Speaker 1: This man has such a narcissist. First of all, who
[3:41] Speaker 1: goes on Reddit and write something like that?
[3:44] Speaker 2: Plus, it's all about him, right? He's like, I want
[3:47] Speaker 2: no strings attached. I want it to be easy. And
[3:50] Speaker 2: college age. Yeah. College age. Must work out.
[3:54] Speaker 1: I'm surprised he didn't say blonde, 5'7. Well, he can't
[3:58] Speaker 1: be picky. Yeah, you're right.
[3:59] Speaker 2: He's not unreasonable.
[4:01] Speaker 1: Prosecutors also allege that Lee had an affair with a
[4:04] Speaker 1: woman in San Diego in 2023 and had been distant
[4:07] Speaker 1: and quiet around his wife before she died.
[4:10] Speaker 2: Read it?
[4:11] Speaker 1: He said? Well, he went on Reddit in 2024, but
[4:14] Speaker 1: prosecutors also claim he had an affair in 2023. So
[4:18] Speaker 1: in 2023, he has an affair with a woman in
[4:20] Speaker 1: San Diego. In 2020, the affair clearly fizzled out. So
[4:23] Speaker 1: now he's on Reddit in 2024. Is Reddit somewhere where
[4:27] Speaker 1: you would try to meet someone?
[4:29] Speaker 2: That's what I was asking. I never considered it as
[4:31] Speaker 2: a source.
[4:31] Speaker 1: I just thought Reddit was where everybody talks bad about housewives.
[4:34] Speaker 2: Well, they do that too.
[4:36] Speaker 1: I didn't know that. Mostly you.
[4:37] Speaker 2: Sorry.
[4:37] Speaker 1: Sorry. It's not just me. I've seen other housewives on
[4:43] Speaker 1: there as well. I didn't know that you could use
[4:46] Speaker 1: Reddit for dating or hooking up.
[4:50] Speaker 2: We should post to Reddit and see how long it takes.
[4:52] Speaker 1: We should post it together.
[4:53] Speaker 2: Yeah, because I don't want to get in trouble.
[4:56] Speaker 1: Transparency. All right. October 7th, 2024 is the day of
[5:01] Speaker 1: the alleged murder. So that day, Lee alleges that he
[5:05] Speaker 1: and Krista had gotten into a fight after he purchased
[5:07] Speaker 1: an SUV without her knowledge. Around 9.30 p.m., Krista and
[5:12] Speaker 1: Lee allegedly put their two children to bed, then went
[5:15] Speaker 1: to sleep in different rooms. Around 11.30 p.m., Lee called
[5:20] Speaker 1: police and said that his pregnant wife was non-responsive, describing
[5:24] Speaker 1: it as a suicide by overdose. However, he later admitted
[5:29] Speaker 1: to investigators that Krista was not suicidal or a drug user.
[5:34] Speaker 1: I don't know what the overdose is supposed to be.
[5:35] Speaker 2: So then he called to report it?
[5:38] Speaker 1: He calls and says that his wife is.
[5:40] Speaker 2: Retracted his statement? Dead.
[5:42] Speaker 1: And that she committed suicide. And then I guess later
[5:46] Speaker 1: admits that she was never suicidal and that she doesn't
[5:49] Speaker 1: do drugs.
[5:50] Speaker 2: Okay.
[5:52] Speaker 1: Krista was rushed to the hospital where staff noticed bruising
[5:56] Speaker 1: and apparent trauma to her face. She was pronounced dead
[5:59] Speaker 1: at the hospital. A Harris County pathologist determined that Krista's
[6:04] Speaker 1: cause of death was compression of the neck and upper back.
[6:07] Speaker 1: The autopsy also showed she was about eight weeks pregnant.
[6:12] Speaker 1: This is October 9th. So October 7th is the day
[6:14] Speaker 1: that she died. October 9th, they say that an autopsy
[6:17] Speaker 1: shows that she was pregnant, but she also has some
[6:20] Speaker 1: problems around her neck and upper back area. And then
[6:23] Speaker 1: on October 11th, Lee was arrested and charged with a
[6:27] Speaker 1: capital murder of his wife and their unborn child.
[6:30] Speaker 2: That's the best one. It's soon after. Yeah. It's like
[6:32] Speaker 2: they don't even get a weekend. I know.
[6:34] Speaker 1: That's why I did the dates. Cause it was like,
[6:35] Speaker 1: she died. Then two days later, they determined that she's pregnant,
[6:40] Speaker 1: but her cause of death, like she's got some, you know,
[6:43] Speaker 1: compression areas in the neck and the upper back. And
[6:45] Speaker 1: then two days after that, he's arrested. Yeah.
[6:47] Speaker 2: Good.
[6:48] Speaker 1: See, this is Texas. Yeah. This is the difference between
[6:52] Speaker 1: Texas and Massachusetts.
[6:54] Speaker 2: Yeah, that's right.
[6:55] Speaker 1: Massachusetts is like.
[6:57] Speaker 2: Texas should just eat up Massachusetts.
[7:00] Speaker 1: Right? We should send like Karen Reed and Sandra Birchmore trial.
[7:04] Speaker 1: We should send them down to Texas.
[7:06] Speaker 2: Yeah, or send the police officers to work in Massachusetts.
[7:08] Speaker 2: They need to fire the whole police station. Didn't I
[7:10] Speaker 2: say that earlier? They need to burn down the police
[7:12] Speaker 2: station in Massachusetts.
[7:13] Speaker 1: Burn it down.
[7:14] Speaker 2: Yes.
[7:14] Speaker 1: Burn it down.
[7:15] Speaker 2: Yes, and then rebuild.
[7:24] Speaker 1: In mid-October of 2024, Lee is initially denied bond. Then, later,
[7:30] Speaker 1: he is granted a million-dollar bond and he's released on
[7:33] Speaker 1: October 17th of 2024. Where did he get the money?
[7:36] Speaker 2: I know.
[7:36] Speaker 1: I knew you were going to ask that. I think
[7:37] Speaker 1: his family and brother and I think everybody kind of
[7:41] Speaker 1: pulled together. And so he is released on– he had
[7:43] Speaker 1: a million-dollar bond, but he's released.
[7:45] Speaker 2: If your sister went to jail– For murder? Yeah. And
[7:49] Speaker 2: she's like, I didn't kill him. I didn't kill him.
[7:52] Speaker 2: And it was her husband, let's say. Yeah. What would
[7:54] Speaker 2: you do? Well, I don't bail her out.
[7:56] Speaker 1: Well, it depends on if I believe her or not.
[7:58] Speaker 1: It's my sister.
[7:59] Speaker 2: It's not my sister.
[8:01] Speaker 1: It's my sister. I would do it. All right. So
[8:04] Speaker 1: Lee gets out on bond and he's ordered to wear
[8:07] Speaker 1: an ankle monitor and surrender his passport. I mean, clearly
[8:11] Speaker 1: that it does nothing for this man. He ends up
[8:13] Speaker 1: in Italy. He was also barred from contacting his children
[8:17] Speaker 1: unless the family court allowed it and from contacting his
[8:20] Speaker 1: wife's family.
[8:21] Speaker 2: That's weird. Why not? Why can't you talk to your kids?
[8:24] Speaker 1: Because this is Texas, man, and he's arrested for murdering
[8:27] Speaker 1: his wife and his unborn child.
[8:29] Speaker 2: So everyone that's arrested for murder can't talk to their kids?
[8:32] Speaker 1: I don't know. He's barred from contacting his children. Well,
[8:35] Speaker 1: I don't know. Her parents... come in under some sort
[8:39] Speaker 1: of conservatorship type of situation and take the two children
[8:43] Speaker 1: and end up taking the kids to South Carolina where
[8:45] Speaker 1: they're from. You know, they're in Texas right now. In
[8:49] Speaker 1: April of 2025, a grand jury indicted Lee on capital
[8:52] Speaker 1: murder charges, covering the deaths of both Krista and their
[8:55] Speaker 1: unborn child. He pleaded not guilty. According to later court filings,
[8:59] Speaker 1: he allegedly talked with the woman he had an affair
[9:01] Speaker 1: with in 2023 about about a detailed plan to cut
[9:04] Speaker 1: off his ankle monitor, flee to Mexico or another country,
[9:08] Speaker 1: and possibly marry to get a new identity. So I
[9:11] Speaker 1: guess he's having conversations with someone he had an affair
[9:13] Speaker 1: with about how he's going to get out of this.
[9:15] Speaker 2: Is this person going to help him? They probably want
[9:17] Speaker 2: to help him leave because they don't want to be murdered.
[9:20] Speaker 1: I don't know. I don't think she helps him. But
[9:22] Speaker 1: I mean, the fact that he's like telling people about
[9:25] Speaker 1: his plans.
[9:27] Speaker 2: You know, it's like I get a speeding ticket. I
[9:29] Speaker 2: was like, I don't want to tell people. That's embarrassing.
[9:31] Speaker 2: Or like a parking ticket. I'm like, oh, sorry. And
[9:34] Speaker 2: I hide it. I go online, pay it so no
[9:36] Speaker 2: one knows. This guy murders people and flees and everything.
[9:40] Speaker 2: It's no shame.
[9:41] Speaker 1: No shame.
[9:42] Speaker 2: No shame.
[9:42] Speaker 1: No shame. All right. So we get to April of 2026.
[9:46] Speaker 1: So this was very recently. This is when I started
[9:48] Speaker 1: reading about it in the news. Prosecutors file paperwork disclosing
[9:52] Speaker 1: the conversations about fleeing. So remember, originally, he's just out
[9:57] Speaker 1: on bond, right? And he has to surrender his past.
[10:01] Speaker 1: Now they're like, okay, we have to do more.
[10:03] Speaker 2: They should just put him in jail.
[10:05] Speaker 1: I know, but they don't. Instead, the solution is, let's
[10:10] Speaker 1: put an ankle monitor on him.
[10:12] Speaker 2: Because clearly he's a law-abiding citizen that'll just leave it
[10:15] Speaker 2: on there and won't tamper with it.
[10:16] Speaker 1: On May 1st, his ankle monitor sent a strap tamper
[10:20] Speaker 1: alert and authorities could not reach him.
[10:22] Speaker 2: On what date?
[10:23] Speaker 1: This is May 1st.
[10:24] Speaker 2: And what date did they put it on him?
[10:26] Speaker 1: I don't know the date that he had his ankle.
[10:28] Speaker 2: April 29th.
[10:29] Speaker 1: But in April of 2026, prosecutors filed paperwork disclosing that
[10:33] Speaker 1: he was having conversations about fleeing. And I guess nothing
[10:37] Speaker 1: was done about it. I don't know. Maybe there was
[10:39] Speaker 1: like a hearing date set or whatever. But then by
[10:42] Speaker 1: May 1st, He's cutting his ankle monitor off.
[10:45] Speaker 2: They're like monitoring. They're like, hey, he's at a Home Depot. Hey,
[10:49] Speaker 2: he's at a Blacksmith. Hey, it's tampered with.
[10:53] Speaker 1: What are we going to do?
[10:54] Speaker 2: Okay, you bragged about Texas, but now what are they doing?
[10:57] Speaker 2: They're putting anklets on these people and sending them out. Anklets.
[11:00] Speaker 2: Isn't that what it is? Isn't that what it is? Yeah.
[11:03] Speaker 1: Well, I don't know. I mean, I've never had one,
[11:05] Speaker 1: but I guess apparently you can just cut it off,
[11:09] Speaker 1: but it has an alert, a strap tamper alert, but
[11:12] Speaker 1: then they couldn't find him. I mean, you get a
[11:14] Speaker 1: strap tamper alert, but you have to get to where
[11:17] Speaker 1: he is, right?
[11:18] Speaker 2: Right. There's clearly... That's just basically saying it's not tracking anymore.
[11:22] Speaker 2: That's all it does.
[11:23] Speaker 1: It's basically saying he cut it off and fled.
[11:25] Speaker 2: He got away with it. Right. But why can you
[11:27] Speaker 2: cut it off so easily?
[11:28] Speaker 1: I don't know. I was wondering the same thing. I
[11:30] Speaker 1: don't know.
[11:31] Speaker 2: I mean, why don't they make it like they do handcuffs?
[11:33] Speaker 2: So you can't cut it off.
[11:35] Speaker 1: Yeah, like you have to have a key to get
[11:36] Speaker 1: it off?
[11:36] Speaker 2: Yeah. Well, I'm sure you have to have a key,
[11:38] Speaker 2: but is it just like a strap?
[11:40] Speaker 1: Is it like Velcro?
[11:41] Speaker 2: Is it just hook and loop?
[11:43] Speaker 1: I don't know, but he got it off. According to
[11:46] Speaker 1: the Houston Chronicle... A flaw in the county's after-hours monitoring
[11:51] Speaker 1: system gave him about a 60-hour head start.
[11:55] Speaker 2: Wait, after? What? Everyone was on vacation or something?
[11:59] Speaker 1: What was it? It says the county's after-hours monitoring system,
[12:03] Speaker 1: there was a flaw in the system, and he got
[12:05] Speaker 1: about a 60-hour head start.
[12:07] Speaker 2: 60 hours?
[12:08] Speaker 1: He's like, sweet. I'm not going to Mexico. I'm going
[12:11] Speaker 1: to Italy. I know.
[12:13] Speaker 2: Are you serious? Yeah.
[12:16] Speaker 1: Okay, sources say, this man is very, he has a
[12:19] Speaker 1: lot of initiative. I will give him that.
[12:21] Speaker 2: If this guy wasn't a murderer, I'd find him really fascinating.
[12:25] Speaker 2: I'd like to pick his brain.
[12:26] Speaker 1: Sources claim that he left his home on a bicycle
[12:29] Speaker 1: and then boarded a private jet in Memphis and then
[12:33] Speaker 1: traveled on the private jet through Canada and then took
[12:38] Speaker 1: a flight to Milan, Italy.
[12:40] Speaker 2: Well, who's private jet?
[12:42] Speaker 1: That's, I know. I do not know.
[12:44] Speaker 2: It's like another one of his mistresses?
[12:46] Speaker 1: I don't know. They think maybe his brother helped him,
[12:48] Speaker 1: but I don't know who has a private jet.
[12:50] Speaker 2: Again, a private.
[12:51] Speaker 1: I don't know who has a private jet.
[12:52] Speaker 2: You know, that's funny, though, because you don't need a passport.
[12:56] Speaker 1: On a private jet? To leave the country with a...
[12:58] Speaker 1: I mean, I think you can get away with it
[13:00] Speaker 1: more when you enter the country. Well, no, he had
[13:02] Speaker 1: fake documentation made. So this man... got out on bond,
[13:07] Speaker 1: has an ankle monitor, manages to get a fake passport
[13:10] Speaker 1: and fake documentation, gets his ankle strap cut off somehow.
[13:14] Speaker 1: I don't know how he does it, gets it off.
[13:16] Speaker 1: Then there's a flaw in the system. So he's got
[13:18] Speaker 1: a 60 hour headstart, rides his bicycle from his house,
[13:21] Speaker 1: goes to a private jet, flies from Memphis to Canada.
[13:25] Speaker 1: He's flying around in Canada, and then he ends up
[13:27] Speaker 1: landing in Milan, Italy. And then Italy's like, oh, well,
[13:31] Speaker 1: you can't give him the death sentence because we don't
[13:33] Speaker 1: have the death sentence in Italy, so we're just going
[13:35] Speaker 1: to keep him here.
[13:36] Speaker 2: That's a good travel buddy. Let me see. If you
[13:40] Speaker 2: missed a flight, he would be able to figure out
[13:41] Speaker 2: a way to get there.
[13:42] Speaker 1: Oh, that's true. He'd be like, he'd be a good
[13:44] Speaker 1: travel buddy. He's like, we'll take a bike. We'll just
[13:46] Speaker 1: bicycle over here. And then I have a friend that
[13:48] Speaker 1: has a private jet. And then we'll just fly over
[13:49] Speaker 1: to Canada. And then we'll end up in Milan.
[13:50] Speaker 2: Oh, you don't need your passport. Let's go.
[13:52] Speaker 1: Or no, he's like, I made a fake one for you.
[13:54] Speaker 2: He's like, you don't need them. Let's go.
[13:56] Speaker 1: All right. So on May 3rd, he arrives in Milan
[14:00] Speaker 1: on forged Belgian documents, including a passport under the name
[14:04] Speaker 1: Lejeune Jean-Luc Olivier. Can you repeat that?
[14:08] Speaker 2: No.
[14:10] Speaker 1: Do you like my French accent? No.
[14:12] Speaker 2: I'm guilty of looking up ankle monitor. Yeah, I know.
[14:16] Speaker 1: You are always Googling when I'm doing podcasts. Shane likes
[14:21] Speaker 1: breaking news. He can't wait until we're done and then
[14:23] Speaker 1: talk about it on a following podcast. He has to
[14:26] Speaker 1: Google right in the middle.
[14:27] Speaker 2: The physical act of removing an ankle monitor is surprisingly easy,
[14:32] Speaker 2: but removing it without triggering an immediate alert to law
[14:34] Speaker 2: enforcement is impossible.
[14:36] Speaker 1: Well, whoop-dee-doo. Well, no, it is possible because he got
[14:39] Speaker 1: a 60-hour head start.
[14:41] Speaker 2: There was a flaw in there. Well, yeah, it's still
[14:42] Speaker 2: notifying him, but he just found out what their vacation
[14:44] Speaker 2: schedule was.
[14:45] Speaker 1: Yeah, he's like, oh.
[14:46] Speaker 2: Maybe the ankle monitor had the hours on it. It's all,
[14:48] Speaker 2: if after 5 p.m., please call. Hey, they don't work
[14:53] Speaker 2: after 5 p.m. And it's a Friday. They probably don't
[14:55] Speaker 2: work on the weekends. Yeah.
[14:57] Speaker 1: So you're thinking, you want to know the time he
[14:59] Speaker 1: cut the ankle monitor. You're thinking it's 5.01 p.m. on
[15:02] Speaker 1: a Friday.
[15:02] Speaker 2: I don't know. 60 hours would lead to Monday.
[15:07] Speaker 1: Yeah, right. Would you like to hear his French name
[15:09] Speaker 1: again on his fake documentation?
[15:11] Speaker 2: Yeah.
[15:11] Speaker 1: It's Lejeune Jean-Luc Olivier.
[15:15] Speaker 2: So does he speak French?
[15:16] Speaker 1: I doubt it.
[15:17] Speaker 2: How does he get away with it, then, if he
[15:18] Speaker 2: doesn't speak French and he totally comes off American?
[15:21] Speaker 1: It says they recognized that the documents were fake. I
[15:24] Speaker 1: wonder if he tried to use a French accent. He's like,
[15:27] Speaker 1: excuse me.
[15:28] Speaker 2: A passaport? I was going to say, well, now he
[15:32] Speaker 2: could dress up as a mime and not talk. Just
[15:34] Speaker 2: be like, you know. They just like gestures, right? And
[15:38] Speaker 2: then they're like, they won't question his accent.
[15:40] Speaker 1: All right. So they recognize that his documents are fake.
[15:43] Speaker 1: They refuse him entry and took him into immigration custody.
[15:47] Speaker 1: He then admitted who he was and claimed asylum. Is
[15:50] Speaker 1: that what you do? Do you just go asylum?
[15:53] Speaker 2: My country is coming after me.
[15:54] Speaker 1: Asylum.
[15:55] Speaker 2: Just because I murdered someone. They're harassing me.
[15:57] Speaker 1: All right. Then May 4th and 5th, a judge revoked
[16:00] Speaker 1: his bond after he failed to appear at a hearing
[16:02] Speaker 1: in the U.S. Well, obviously he's failing to appear. When
[16:06] Speaker 1: his name was called three times in the courthouse hallway,
[16:09] Speaker 1: prosecutors described his flight to the court. His trial had
[16:13] Speaker 1: been scheduled for late May. They're like, your honor, he
[16:18] Speaker 1: took off on a bike and then he cut his
[16:20] Speaker 1: ankle monitor off and then he took a private jet.
[16:23] Speaker 2: All right.
[16:24] Speaker 1: In a Milan courtroom, he refused to consent to extradition
[16:27] Speaker 1: and sought to stay in Italy while pursuing asylum. He
[16:30] Speaker 1: told the judge, Killed by who? He's talking about how
[16:33] Speaker 1: they're going to seek the death penalty. In his case.
[16:49] Speaker 1: And so he's telling the Italian court, the Italian government... Oh,
[16:53] Speaker 1: that's not happening to me.
[16:54] Speaker 2: Murder people. They're going to come after you.
[16:55] Speaker 1: Don't allow them to extradite me back to the U.S.
[16:59] Speaker 1: He went to Italy on purpose because Italy does not
[17:01] Speaker 1: recognize the death penalty or life in prison without parole.
[17:03] Speaker 1: Did you know that?
[17:04] Speaker 2: And they have no extraditing?
[17:06] Speaker 1: Well, no, they do. But they... They want to make
[17:10] Speaker 1: sure that if he's extradited to the United States, that
[17:13] Speaker 1: they don't pursue the death penalty or life without parole
[17:18] Speaker 1: because Italy does not recognize those two sentences. So, all right,
[17:24] Speaker 1: then we get to late May and early June. The
[17:26] Speaker 1: million dollar bond was ordered forfeited. The DOJ had 45
[17:30] Speaker 1: days from May 8th to formally submit an extradition request
[17:34] Speaker 1: and Italy confirmed that it received it. A Harris County
[17:37] Speaker 1: family court set a June 18th hearing on whether the
[17:40] Speaker 1: couple's children who are living with Krista's parents in South
[17:43] Speaker 1: Carolina must return to Texas. You know, I read about
[17:47] Speaker 1: this and I thought that was interesting. So while he's
[17:49] Speaker 1: in Italy and the United States is trying to extradite
[17:51] Speaker 1: him back to Texas, her parents have the two minor children, right?
[17:57] Speaker 1: They took some type of guardianship or conservatorship. They moved
[18:01] Speaker 1: them to South Carolina. Now those guardianship Two children, I
[18:04] Speaker 1: think it's two girls, but I'm not exactly sure, have
[18:06] Speaker 1: been living in South Carolina with her parents around her
[18:09] Speaker 1: whole family. So they have cousins and aunts and uncles
[18:11] Speaker 1: and grandparents. They're going to school there.
[18:14] Speaker 2: They're totally rooted into the system there.
[18:17] Speaker 1: Then the family court rules that they need to go
[18:19] Speaker 1: back to Texas.
[18:21] Speaker 2: Who's in Texas?
[18:22] Speaker 1: Nobody. There's nobody in Texas. I know. I guess it was.
[18:25] Speaker 2: The best interest of the children would be where they
[18:28] Speaker 2: are and where they have been.
[18:29] Speaker 1: Exactly.
[18:29] Speaker 2: Exactly.
[18:31] Speaker 1: He also faces a federal charge of interstate flight to
[18:34] Speaker 1: avoid prosecution. Also, there's no information about who has this
[18:37] Speaker 1: private jet, and I want to know that. I want
[18:39] Speaker 1: to know how he managed to secure a private jet
[18:45] Speaker 1: in his escape plan.
[18:46] Speaker 2: Well, I would assume he piggybacked off of someone that
[18:48] Speaker 2: was already flying.
[18:50] Speaker 1: Yeah, but how do you get someone to agree to
[18:52] Speaker 1: that when they know you have an ankle monitor and
[18:54] Speaker 1: you're on a million-dollar bond?
[18:55] Speaker 2: He doesn't have an ankle monitor. He took it off. Yeah.
[19:05] Speaker 1: All right, then we get to July 15th. At a
[19:07] Speaker 1: hearing before the Turin Court of Appeal, Lee said he
[19:10] Speaker 1: was seeking protection in Italy. So they have a hearing
[19:13] Speaker 1: in Italy on this man. The court in Italy blocks
[19:17] Speaker 1: the extradition request and it asks U.S. officials whether he
[19:20] Speaker 1: could be convicted of a lesser offense carrying a lighter
[19:23] Speaker 1: penalty closer to Italy's system where the maximum sentence is
[19:27] Speaker 1: considered 26 years. Italy abolished capital punishment in 1947 and
[19:33] Speaker 1: it is strictly banned under the Italian constitution. You know,
[19:36] Speaker 1: I don't know if he knew that. Do you think
[19:38] Speaker 1: he did his research and knew that if he fled
[19:40] Speaker 1: to Italy and he could actually get in Italy and
[19:42] Speaker 1: put two feet down an italian soil maybe maybe that
[19:48] Speaker 1: it would be a problem to extradite him back because.
[19:50] Speaker 2: Maybe i mean that would that would make sense that
[19:54] Speaker 2: if he's going to go somewhere he would look somewhere
[19:55] Speaker 2: that would give him some protection.
[19:58] Speaker 1: Because that's very interesting that the italian court is like
[20:00] Speaker 1: look Yeah. We might let him go back, but you
[20:03] Speaker 1: guys have to charge him with something less.
[20:05] Speaker 2: It's like we're serious on this thing.
[20:07] Speaker 1: Because we don't recognize that.
[20:08] Speaker 2: You don't want to give him the credit for being
[20:10] Speaker 2: that sophisticated, huh?
[20:11] Speaker 1: I know. But, I mean, it seems like he did
[20:12] Speaker 1: his homework or else he just got really, really lucky.
[20:15] Speaker 2: Well, where have you been? This guy fled. He had
[20:19] Speaker 2: multiple ways of transporting himself. He had no ankle bracelet.
[20:22] Speaker 2: He got out on bail. He's sleeping with women while
[20:25] Speaker 2: he's sleeping with other women. I mean.
[20:26] Speaker 1: He's just a lucky man.
[20:28] Speaker 2: I don't know if it's luck because... He doesn't have
[20:31] Speaker 2: his kids and he's in jail. I don't know.
[20:33] Speaker 1: Then we get to September 7th. This is another hearing
[20:36] Speaker 1: in Italy. The extradition back to the United States is
[20:39] Speaker 1: delayed again. Then September 14th and 15th, the Italian court
[20:44] Speaker 1: asked the Harris County DA to formally promise never to
[20:48] Speaker 1: seek the death penalty.
[20:49] Speaker 2: Why would they go so far? You'd think they'd just
[20:50] Speaker 2: be like, yeah, can you take this guy? Because we
[20:52] Speaker 2: don't want all these extra court dates.
[20:54] Speaker 1: I know. I don't understand. They're very, very, very committed
[20:58] Speaker 1: to this man getting a lighter sentence.
[21:02] Speaker 2: Yeah. Okay.
[21:02] Speaker 1: So the grandparents were ordered to return the kids to Texas,
[21:07] Speaker 1: which means that's awful because that means they have to
[21:09] Speaker 1: take them out of the school that they're in. They
[21:10] Speaker 1: have to take them away from family.
[21:12] Speaker 2: They don't even have any property in Texas. They have
[21:15] Speaker 2: to find a place to live. They have to start over.
[21:17] Speaker 1: Yeah, they have to relocate. I don't know. Do they
[21:19] Speaker 1: have jobs? They have to find jobs there. They have
[21:21] Speaker 1: to get an apartment or buy a house. I mean,
[21:25] Speaker 1: that's awful to put that burden on two grandparents.
[21:27] Speaker 2: What are we missing? There had to have been something.
[21:29] Speaker 2: That makes no sense.
[21:31] Speaker 1: I don't know. All I read was that the court
[21:34] Speaker 1: that ordered it, the family court that ordered it, I
[21:36] Speaker 1: guess this is in South Carolina, said that Texas had
[21:38] Speaker 1: a better understanding of the case because this is where
[21:41] Speaker 1: it all happened, so that the kids should be ordered
[21:44] Speaker 1: back there. I guess they wanted to just keep this
[21:46] Speaker 1: whole case, not have a family court case in South
[21:48] Speaker 1: Carolina and then a criminal case in Texas.
[21:50] Speaker 2: Yeah, but okay, we want it convenient for you, but
[21:53] Speaker 2: what about the kids?
[21:55] Speaker 1: Exactly.
[21:55] Speaker 2: That's not the best interest of the court. It's the
[21:57] Speaker 2: best interest of the kids.
[21:58] Speaker 1: Exactly. All right, now we get to the latest developments
[22:03] Speaker 1: in this case. We're at October 7th. Lee was scheduled
[22:06] Speaker 1: to appear again before the Italian Court of Appeal the
[22:10] Speaker 1: same day Chris's parents, Chris and Sharon Bauer, filed a
[22:14] Speaker 1: wrongful death suit against him in Harris County District Court.
[22:18] Speaker 1: The suit seeks more than a million dollars in damages.
[22:21] Speaker 1: Their attorney said the goal is to hold him accountable
[22:23] Speaker 1: and keep him from recovering assets. The family has said
[22:27] Speaker 1: it does not want him executed. As of today, Lee
[22:32] Speaker 1: Gilley remains in Italy and his asylum claim is still pending.
[22:36] Speaker 1: Any decision to send him back can still be appealed
[22:39] Speaker 1: to Italy's court of cassation. So we will continue to
[22:43] Speaker 1: follow Lee Gilley and see if he actually ends up
[22:45] Speaker 1: back in Texas. Lee Gilley? Yeah. Sounds like a country singer.
[22:49] Speaker 2: Sounds like legally. Oh, legally. Legally.
[22:53] Speaker 1: Yeah. Yeah, you're right. It does. I thought it sounded
[22:57] Speaker 1: like a country singer. Lee Gilley.
[22:59] Speaker 2: No, I thought it sounded like the word legally.
[23:01] Speaker 1: Okay, you're right.
[23:01] Speaker 2: All right. Legally brunette.
[23:04] Speaker 1: Legally brunette.
[23:05] Speaker 2: Yes.
[23:06] Speaker 1: All right, we're going to continue to follow this case
[23:08] Speaker 1: because I find it fascinating.
[23:10] Speaker 2: Wait, as of now, he's in Italy.
[23:11] Speaker 1: He's still in Italy.
[23:12] Speaker 2: And his kids are in Texas.
[23:14] Speaker 1: Are in Texas with the grandparents. I want to know
[23:17] Speaker 1: how the grandparents are. Did they have to rent a house?
[23:19] Speaker 1: Did they buy a house? Did they have to get
[23:21] Speaker 1: new jobs in Texas?
[23:22] Speaker 2: It was for them if they pulled it off.
[23:24] Speaker 1: Yeah, how are they doing? What's going on in the
[23:27] Speaker 1: family court?
[23:28] Speaker 2: I don't know.
[23:29] Speaker 1: And Lee Gilley needs to get on a flight. He
[23:31] Speaker 1: needs to get on his private jet and he needs
[23:33] Speaker 1: to go back to Texas where he needs to be tried.
[23:35] Speaker 2: And put his accessories back on.
[23:39] Speaker 1: Put his ankle monitor back on. They need a better
[23:42] Speaker 1: ankle monitor after this situation. Do you think they redesigned
[23:45] Speaker 1: them after this?
[23:45] Speaker 2: No.
[23:46] Speaker 1: No?
[23:47] Speaker 2: No, I think they're just kind of buckled on in
[23:50] Speaker 2: a way.
[23:51] Speaker 1: All right, guys, thank you so much for listening till
