The murder of Laci Peterson and her unborn son, Conner, was one of the most talked about crime cases in the early 2000’s. Scott Peterson: the husband, soon-to-be father & convicted murderer was picked apart by the media… But was it well deserved? The truth is, Scott didn’t do himself any favors by having an affair, looking particularly uninterested in finding his wife, and allegedly trying to flee the state. Despite all of this circumstantial evidence, does Emily still believe his innocence? See omnystudio.com/listener for privacy information.

[0:02] Speaker 1: Hi, guys, welcome to Legally Brunette. I will be your
[0:04] Speaker 1: host today, Emily Simpson with Shane. Okay, guys, today we
[0:09] Speaker 1: are doing the big One. I have avoided doing an
[0:13] Speaker 1: episode on this case just because it's so complex. This
[0:17] Speaker 1: is Scott Peterson and Lacy Peterson, which I'm sure you'd
[0:20] Speaker 1: have to live under a rock to not know about
[0:23] Speaker 1: Lacy Peterson, right, Lacy Peterson, Lacy Peterson. Now, the timing
[0:29] Speaker 1: of doing this episode, we wanted to. I have had
[0:32] Speaker 1: lots of people ask if we were going to do it,
[0:34] Speaker 1: but I also knew. I'm not sure. I think it
[0:36] Speaker 1: was twenty twenty three that the la Innoson's project took
[0:38] Speaker 1: up Scott Peterson's case, which I did know about. I
[0:42] Speaker 1: wanted to wait until we did the Scott Peterson case
[0:46] Speaker 1: until a lot of that information and a lot of
[0:48] Speaker 1: that evidence, and a lot of the new things that
[0:50] Speaker 1: they are purporting came out publicly teeth into right. So,
[0:55] Speaker 1: now that I did get a hold of the petition
[0:58] Speaker 1: that the la Innocon's probably filed on behalf of a
[1:01] Speaker 1: Scott Peterson. It's eight hundred and fifty four pages. I
[1:04] Speaker 1: did not read the whole thing, but I did pick
[1:06] Speaker 1: and choose from it and have been going over it anyway.
[1:09] Speaker 1: Now I feel like and also we know that the
[1:11] Speaker 1: new documentary came out with like the New Evidence. Yeah,
[1:16] Speaker 1: well I watched it on Hulu.
[1:17] Speaker 2: Hulu.
[1:18] Speaker 1: Yeah. So now we have something that we can divide
[1:22] Speaker 1: into two parts. So today we were going to do
[1:23] Speaker 1: part one of the Scott Peterson case. We were just
[1:25] Speaker 1: going to go back in time, back to two thousand
[1:27] Speaker 1: and two. We're going to talk about the case. We're
[1:29] Speaker 1: going to talk about the circumstantial by the way, it's
[1:32] Speaker 1: all circumstantial evidence against Scott Peterson, the trial, how he
[1:37] Speaker 1: ended up in prison, he ended up on death row.
[1:39] Speaker 1: I don't know if you know, but he's not on
[1:40] Speaker 1: death row anymore. He's in for life without parole, but
[1:42] Speaker 1: he's not on death row anymore anyway. So today is part.
[1:46] Speaker 2: One, death row. I mean, you're going to die in jail, well.
[1:49] Speaker 1: Right, but he's not going to just natural cause he's
[1:51] Speaker 1: not going to be executed anyway. So today we're going
[1:55] Speaker 1: to go into part one, and then we are going
[1:58] Speaker 1: to record a separate episode in part two when we
[1:59] Speaker 1: are going to go into the Los Angeles Innocence Project
[2:04] Speaker 1: and their findings and the new information. So are you ready?
[2:11] Speaker 2: All right?
[2:11] Speaker 1: All right?
[2:12] Speaker 2: So wait, no, currently currently prior to let's say, go
[2:16] Speaker 2: back two years ago, okay, twenty what was your belief
[2:22] Speaker 2: as to the crime.
[2:24] Speaker 1: No, two years ago, I was questioning whether he was guilty.
[2:27] Speaker 2: Five years ago, five years ago.
[2:29] Speaker 1: Oh, absolutely he did it. And I also would like
[2:31] Speaker 1: to ask the listeners that not so much in part one,
[2:34] Speaker 1: but definitely when we get to part two, you're gonna
[2:35] Speaker 1: have to be a little more open minded.
[2:38] Speaker 3: And I just wanted to set the record straight at
[2:42] Speaker 3: a point, Yes, Emily was very convinced, as many were
[2:47] Speaker 3: and everyone is, that he was guilty, right, like beyond
[2:51] Speaker 3: a reasonable doubt, right, Okay, just wanted to make so
[2:54] Speaker 3: it's not like, okay and then you saw the light.
[2:58] Speaker 2: Well, I don't know whatever. Well, GE's no idea what
[3:01] Speaker 2: the evidence is that's going to come before us.
[3:02] Speaker 1: So let's get We'll get to that in part two,
[3:04] Speaker 1: but let's go through this. So on Christmas eve A,
[3:06] Speaker 1: two thousand and two. Also, by the way, this was
[3:08] Speaker 1: two thousand and two. Do you remember this in the media.
[3:11] Speaker 2: I just want to that was an adult too.
[3:13] Speaker 1: No, I know, but I mean, do you remember how
[3:15] Speaker 1: much it was in the idea, how much it was covered.
[3:18] Speaker 2: I remember when he was being prosecuted, then it was
[3:23] Speaker 2: made eleivised and all over the place. But yes, I
[3:27] Speaker 2: think in two thousand and two, I remember like surfacing
[3:30] Speaker 2: as a you know, breaking news and things like that,
[3:34] Speaker 2: and then it died and then you forget about it,
[3:36] Speaker 2: especially when I'm at that age when school and whatever.
[3:38] Speaker 2: And then it surfaced as a trial, and that a
[3:42] Speaker 2: lot of coverage.
[3:43] Speaker 1: On Christmas Eve A two thousand and two, Lacy Peterson,
[3:46] Speaker 1: who was eight months pregnant, disappeared from her home in Modesto, California.
[3:51] Speaker 1: Her husband, Scott, said that he had spent the day
[3:53] Speaker 1: on a solo fishing trip out in the San Francisco Bay,
[3:57] Speaker 1: a strange choice for Christmas Eve, but it didn't raise
[4:00] Speaker 1: any immediate red flags. The longer investigators looked at Scott Peterson,
[4:04] Speaker 1: the harder it became for them to look away. There
[4:07] Speaker 1: was a secret affair. There was behavior that felt off,
[4:11] Speaker 1: not the frantic desperate energy of a man whose wife
[4:13] Speaker 1: an unborn child were missing. Then April rolled around and
[4:18] Speaker 1: the bay that Scott had fished in that Christmas Eve
[4:20] Speaker 1: morning killed all Hope of Lacy and Connor coming back.
[4:23] Speaker 1: There were two sets of human remains that washed up
[4:26] Speaker 1: on the shore close to where Scott said that he
[4:28] Speaker 1: had been fishing. What came next was a trial that
[4:31] Speaker 1: gripped the entire country in a verdict that landed in
[4:34] Speaker 1: a packed courtroom broadcast live with millions of people watching
[4:38] Speaker 1: from home. Also, I just want to say, in two
[4:41] Speaker 1: thousand and two, I was in law school, but I
[4:43] Speaker 1: was so overwhelmed by law school that I mean, I
[4:46] Speaker 1: knew about it, but I didn't pay close attention to
[4:51] Speaker 1: the details and follow it, you know what I mean.
[4:54] Speaker 2: I had nothing to other things. It had to do
[4:55] Speaker 2: with schooling.
[4:56] Speaker 1: Yes, I was very busy. I was in law school.
[4:58] Speaker 1: May fourth, nineteen sev Lacey Denise Rocha is born in Modesto, California,
[5:04] Speaker 1: to Sharon and Dennis Roacha. She grows up partly on
[5:07] Speaker 1: her family's dairy farman later studies ornamental horticulture. Do you
[5:10] Speaker 1: know what ornamental horticulture is?
[5:13] Speaker 2: Horticulture's vegetation, right.
[5:14] Speaker 1: Well, horticulture is like, I don't know. I think if
[5:16] Speaker 1: you want to be a landscaper or something like that,
[5:19] Speaker 1: you study all the plants and the genesis and all
[5:21] Speaker 1: those things. But I didn't know what ornamental horticulture. To me,
[5:24] Speaker 1: I guess that means more like residential maybe planning, like
[5:28] Speaker 1: different types of anyway, all right, she studied this.
[5:32] Speaker 2: We don't need to know because we probably never hear that.
[5:34] Speaker 1: I know, I just I found that interesting. She studied
[5:37] Speaker 1: at the California Polytech State University and San Louis Obispo,
[5:42] Speaker 1: and she was there in the summer of nineteen ninety four.
[5:44] Speaker 1: While attending cal Poly, Lacey meets Scott Lee Peterson.
[5:48] Speaker 2: Has put out some victims there.
[5:50] Speaker 1: You know what. And when I read this initially, I
[5:53] Speaker 1: read and this is a fun fact, Lacy Peterson and
[5:57] Speaker 1: Kristen Smart were at cal Poly at this same time.
[6:01] Speaker 1: Do you not find that interesting?
[6:02] Speaker 2: Really?
[6:03] Speaker 1: Yes? Yeah, that's so interesting. So col Pauly has put
[6:07] Speaker 1: out Lacy Peterson and has put out Kristen Smart. I
[6:10] Speaker 1: have decided that cal Poly is not on and Chester
[6:13] Speaker 1: the molester. Cal Poly is not on the list of
[6:15] Speaker 1: colleges that Annabel will be attending in any way, Shaefer Farm.
[6:18] Speaker 2: You could probably go to any single college and find
[6:21] Speaker 2: some unfortunate crimes like that. So what is she never
[6:24] Speaker 2: going to go to school?
[6:24] Speaker 1: Again, what are the chances of lace the huge crimes
[6:28] Speaker 1: Lacey Peterson and Kristen Smart or both at cal Paully.
[6:32] Speaker 2: They're not huge crimes. They're murder no less than any
[6:35] Speaker 2: other murder, no more.
[6:37] Speaker 1: I'm talking about the media attention on a global basis.
[6:40] Speaker 2: Two to go to school where the crimes are swept
[6:43] Speaker 2: under the rug, and they'll get media.
[6:44] Speaker 1: I want her to go where there's no crime, all right.
[6:48] Speaker 1: So she meets Scott Lee Peterson, who is a fellow
[6:50] Speaker 1: student who is working as a waiter at the Pacific Cafe.
[6:53] Speaker 1: Lacy leaves him her phone number and they begin dating.
[6:56] Speaker 1: Soon afterward. Around Christmas of nineteen ninety four, Scott and
[6:59] Speaker 1: Lacey become engaged, and then August ninth of nineteen ninety seven,
[7:03] Speaker 1: Scott and Lacey mary at Sycamore Mineral Springs resort in
[7:07] Speaker 1: California's of Villa Valley, approximately one hundred and fifty family
[7:11] Speaker 1: members and friends at ten. In June of nineteen ninety eight,
[7:14] Speaker 1: Scott graduates from cal Poly with a degree and agricultural business,
[7:19] Speaker 1: and he and Lacey later operate a Hamburger restaurant called
[7:23] Speaker 1: The Shack. That's interesting, I didn't know that. I think
[7:27] Speaker 1: the first time around that they owned a restaurant together,
[7:29] Speaker 1: like a small little yeah. I think it was popular
[7:32] Speaker 1: near cal Poly for students.
[7:37] Speaker 4: Hi, it's Jenny Garth, hosts of the I Choose Me podcast.
[7:41] Speaker 4: This week Monica Lewinsky. Yes, that Monica, the one the
[7:45] Speaker 4: world tore apart. She's still standing. She's back and done hiding.
[7:49] Speaker 1: It really felt like it was one of those situations
[7:53] Speaker 1: where you literally do or die.
[7:55] Speaker 4: Monica stared down shame and came out the other side,
[7:59] Speaker 4: and she is here to change what you thought you knew.
[8:02] Speaker 4: And it's sort of not over until we try it.
[8:04] Speaker 4: A conversation that will inspire you to choose yourself starting today.
[8:09] Speaker 4: Listen to I Choose Me on the iHeartRadio app, Apple Podcasts,
[8:12] Speaker 4: or wherever you get your podcasts.
[8:19] Speaker 1: In two thousand, Scott and Lacey sell the shack and
[8:22] Speaker 1: moved to Medesto to be closer to Lacey's family as
[8:24] Speaker 1: they plan to have children. They purchased the home at
[8:27] Speaker 1: five twenty three Covina Avenue. All right, please add that
[8:30] Speaker 1: to my Leely Brunette tour. That's their home. It's in Modesto.
[8:33] Speaker 1: The address is five twenty three Covina Avenue. Scott works
[8:37] Speaker 1: for the agricultural Supply Company Trade Corp. While Lacey works
[8:41] Speaker 1: as a substitute teacher. He sells fertilizer.
[8:43] Speaker 2: Did you know that he's been selling it ever since?
[8:46] Speaker 1: Yeah. June of two thousand and two, after experiencing difficulty
[8:50] Speaker 1: conceiving and undergoing fertility treatments, Lacey announces that she is pregnant.
[8:54] Speaker 1: The couple learns they are expecting a boy, and they
[8:57] Speaker 1: plan to name him Connor. I know of the other
[9:00] Speaker 1: issues that came up at trial, and I don't know
[9:02] Speaker 1: if we get a lot into it, but they're the prosecution.
[9:05] Speaker 1: I do believe alleged that part of the reason that
[9:08] Speaker 1: he allegedly killed Lacey was because he did not want
[9:11] Speaker 1: to have children, and that he had made it clear
[9:13] Speaker 1: that he didn't want to have children, so that was
[9:16] Speaker 1: a source of the for are.
[9:18] Speaker 2: Other measures to take so you don't have children other
[9:21] Speaker 2: than killing your family?
[9:23] Speaker 1: Again, I said, allegedly killed, And I'm just saying that.
[9:29] Speaker 2: Well, right, don't you Well it sounds like you're going
[9:32] Speaker 2: in the direction of wrongfully blamed for killing.
[9:36] Speaker 1: Maybe possibly, but we're going to talk about that in
[9:38] Speaker 1: part two.
[9:39] Speaker 2: We got Part two.
[9:39] Speaker 1: On November twentieth of two thousand and two, Scott begins
[9:42] Speaker 1: a romantic relationship with Fresno massage therapist Amber Fry, after
[9:47] Speaker 1: being introduced to her by a friend named Sean Sibley.
[9:51] Speaker 1: Scott tells Amber that he is single and lives alone
[9:54] Speaker 1: in Sacramento. From November to December of two thousand and two,
[9:58] Speaker 1: Scott becomes involved in Amber's life and spends time with
[10:01] Speaker 1: her young daughter. According to Amber, he discusses a future
[10:04] Speaker 1: with them, but says he does not want biological children
[10:07] Speaker 1: of his own and has considered having a vasectomy. In
[10:11] Speaker 1: early December of two, Sean Sibley, he was the friend
[10:14] Speaker 1: that introduced them, learns that Scott is married and confronts him.
[10:17] Speaker 1: Scott reportedly claims that he has lost his wife, but
[10:21] Speaker 1: does not explain what happened to her. December of two
[10:26] Speaker 1: thousand and two, Scott purchases as small he.
[10:30] Speaker 2: Has to say he has a wife beat because they
[10:32] Speaker 2: know he has kids.
[10:34] Speaker 1: Who has kids?
[10:35] Speaker 2: Well, why is he saying he lost his wife?
[10:37] Speaker 1: Because he's having an affair and he doesn't want her
[10:40] Speaker 1: to She never knows that he's married.
[10:42] Speaker 2: But that's the thing. Why did he even have to
[10:44] Speaker 2: say that. Why can't you say I'm single?
[10:46] Speaker 1: I don't. I don't know, because he just says he
[10:50] Speaker 1: lost his wife. He says he doesn't look he's a douchebag.
[10:52] Speaker 1: I'm not disputing that the.
[10:53] Speaker 2: Guy is a I wasn't alleging that. I was just saying,
[10:56] Speaker 2: why why does he have to come up with a story.
[10:58] Speaker 1: That's his story he comes up with, and I believes
[11:00] Speaker 1: that's what he tells amberfry to He says that he
[11:02] Speaker 1: lost his wife. This is before it's weird. This is
[11:05] Speaker 1: before Lacey disappears.
[11:06] Speaker 2: No, I do.
[11:07] Speaker 1: That's not great for him. That doesn't look great for him.
[11:09] Speaker 2: I will love it looks great for this guy.
[11:10] Speaker 1: I will agree with that. In December of two thousand
[11:13] Speaker 1: and two, Scott purchases a small fishing boat for approximately
[11:16] Speaker 1: fourteen hundred dollars in cash and keeps it at his
[11:19] Speaker 1: warehouse without telling Lacey. We'll dispute that. Later records later
[11:26] Speaker 1: introduced by prosecutors reportedly showed that he researched boats, fishing locations,
[11:30] Speaker 1: and fish in season and currents in San Francisco.
[11:34] Speaker 2: Saying that is this statement that he bought it without
[11:38] Speaker 2: her knowing and did not disclose it to her, implying
[11:43] Speaker 2: that it was in preparation of, yes, fishing trips with
[11:50] Speaker 2: dead bodies. He threw me off when you said, fishing
[11:52] Speaker 2: trips with dead bodies.
[11:53] Speaker 1: The prosecution during the trial alleges that the boat was
[11:57] Speaker 1: bought in secret as a premeditation to tactic in order
[12:01] Speaker 1: to get rid of his wife, and that she did
[12:03] Speaker 1: not know about the boat.
[12:05] Speaker 2: However, that means nothing to me. So whether he told
[12:09] Speaker 2: her or not does not imply murder or not murder.
[12:13] Speaker 1: Well, but that's part of their I mean, it's all
[12:16] Speaker 1: circumstantial evidence that he's convicted on.
[12:18] Speaker 2: You can see the fishing boat and be like, wait,
[12:20] Speaker 2: what do you have planned for me? What's going on here?
[12:22] Speaker 1: No, but there there. Their argument is that he bought
[12:26] Speaker 1: it in secret so that he could get rid of
[12:28] Speaker 1: the body. And no one knows that he has a
[12:30] Speaker 1: fishing boat.
[12:31] Speaker 2: That's what they're other people knowing he has a fishing.
[12:34] Speaker 1: It was supposed to Well, he claims, we're going to
[12:37] Speaker 1: get into this impartant too, because there's more. He has
[12:40] Speaker 1: a boat, right, but he claims that he bought the
[12:43] Speaker 1: boat as a gift for his father in law, and
[12:47] Speaker 1: that and then the prosecution during the trial makes it
[12:49] Speaker 1: out to be like it's a secret fishing boat that
[12:51] Speaker 1: nobody knew about, and this is his way of premeditated
[12:54] Speaker 1: that he knows he's going to kill her, and this
[12:55] Speaker 1: is his way of getting rid of the body. However,
[12:58] Speaker 1: we will dispute that later. We're not going to do
[12:59] Speaker 1: that now, Part two, Part two. According to Amber, this
[13:05] Speaker 1: is December ninth of two thousand and two. So this
[13:07] Speaker 1: timeline's very important because you know that Lacey is going
[13:10] Speaker 1: to disappear soon. So December ninth of two thousand and two,
[13:13] Speaker 1: according to Amber, Scott tells her that he has lost
[13:16] Speaker 1: his wife and that the upcoming holiday will be his
[13:19] Speaker 1: first without her. This conversation occurs approximately two weeks before
[13:23] Speaker 1: Lacey actually does disappear. Now, this does not look great
[13:26] Speaker 1: for Scott.
[13:27] Speaker 2: Nothing it looks great for Scott.
[13:29] Speaker 1: I know, nothing looks great. I understand. But when we
[13:32] Speaker 1: get to part two, there are going to be some
[13:34] Speaker 1: things that you are going to have to No, no,
[13:37] Speaker 1: we can't.
[13:37] Speaker 2: We gotta do this and then we'll do a prequel.
[13:39] Speaker 1: But one this does bother me that he continues to
[13:43] Speaker 1: tell people that he lost his wife. Why not like
[13:46] Speaker 1: you said, why not just say you're single? I don't.
[13:48] Speaker 1: I don't know.
[13:49] Speaker 2: Yeah, I don't tell people I lost you. I had
[13:50] Speaker 2: to say I'm single.
[13:52] Speaker 1: Oh well, that's great.
[13:54] Speaker 2: They let make me feel better.
[13:55] Speaker 1: I feel great now, thank you. Now, I know you're
[13:56] Speaker 1: not going to kill me, get on me. You're not
[13:58] Speaker 1: going to kill me.
[13:58] Speaker 2: Though, And I don't by the fishing boat, I tell you, yeah.
[14:01] Speaker 1: I would know if you had a fishing boat. I
[14:03] Speaker 1: know everything you do, I know everywhere you do anything.
[14:07] Speaker 1: All right, Now we get to December twenty at the
[14:08] Speaker 1: two thousand and two, Scott purchases a two day fishing
[14:11] Speaker 1: license valid for December twenty third and the twenty fourth.
[14:15] Speaker 1: All right, December twenty third to two thousand and two,
[14:17] Speaker 1: So this is the day before we know is.
[14:19] Speaker 2: He a fisherman by trade?
[14:21] Speaker 5: Like?
[14:21] Speaker 2: Is he?
[14:21] Speaker 1: I think he enjoys fishing.
[14:23] Speaker 2: So that's not that's It's not like if I bought
[14:24] Speaker 2: a fishing boat, you'd like, can never fish in your life?
[14:26] Speaker 1: Would you know if you bought a fishing boat, that
[14:28] Speaker 1: would be weird. I went and call Shane outdoorsy a
[14:33] Speaker 1: fisherman or outdoorsy.
[14:36] Speaker 2: Like I can't go out. I'm trapped at home all
[14:37] Speaker 2: the time, right, you keep me kept in here?
[14:39] Speaker 1: Yes, I'm sorry, all right, false imprisonment, all right. So
[14:43] Speaker 1: now we get to December twenty third to two thousand
[14:45] Speaker 1: and two. This is the day before her disappearance, and
[14:48] Speaker 1: this is the day before Christmas Eve. Lacey visits the
[14:51] Speaker 1: salon where her half sister, Amy Roacha works. Amy assumes
[14:55] Speaker 1: that Scott plans to golf the following day because she
[14:57] Speaker 1: had recently cut his hair for that purpose. I don't know.
[15:00] Speaker 1: I guess he needed a haircut for a golf outing,
[15:02] Speaker 1: he does tell police when they interview him. I do
[15:05] Speaker 1: remember that they said, what were your plans for that day?
[15:08] Speaker 1: He's going through the timeline of when Lacey, you know, disappeared.
[15:11] Speaker 1: He had seen her that morning. He says that he'd
[15:13] Speaker 1: planned either to go golfing or to go fishing. So
[15:17] Speaker 1: the fishing trip, according to him in the interviews, was
[15:20] Speaker 1: a spontaneous Okay, I'm just going to go fishing. December
[15:24] Speaker 1: twenty third to two thousand and two, approximately at eight
[15:27] Speaker 1: thirty pm, Lacey does speak briefly with her mother, Sharon Roache.
[15:31] Speaker 1: This is the last confirmed contact that anyone other than
[15:35] Speaker 1: Scott has with her.
[15:36] Speaker 2: This is on the twenty third.
[15:38] Speaker 1: This is the twenty third, so this is the day
[15:40] Speaker 1: before Christmas Eve. Now we get to December twenty fourth,
[15:42] Speaker 1: at two thousand and two. It is the morning time.
[15:45] Speaker 1: Scott later tells investigators that he and Lacey ate breakfast
[15:48] Speaker 1: and watched Martha Stewart Living. He says Lacey planned to
[15:52] Speaker 1: mop the floor and walk the couples this old watch
[15:55] Speaker 1: riever Mackenzie more innocent.
[15:57] Speaker 2: Ah, we were watching Martha Stewart Living.
[16:00] Speaker 1: Yes, okay, But this is funny though, because he does
[16:02] Speaker 1: tell investigators that and they don't believe him at all,
[16:05] Speaker 1: and I believe they don't do their due diligence. So
[16:08] Speaker 1: then in trial, I believe that they think that they're going.
[16:12] Speaker 2: To be They question him, like what she was preparing
[16:14] Speaker 2: that day, Martha Stewart.
[16:16] Speaker 1: Or something, Yes, and he said merengue, and.
[16:18] Speaker 2: Then they looked it up.
[16:19] Speaker 1: They didn't look it up. They just assumed that he
[16:21] Speaker 1: was lying. Then the defense pulls up the actual episode
[16:29] Speaker 1: and she does talk about marengue. Oh, I think they
[16:33] Speaker 1: talked about marringe at nine forty eight in the morning,
[16:35] Speaker 1: So that's establishing a time.
[16:37] Speaker 2: You're like, that would be weird if it was like,
[16:39] Speaker 2: what if they watched Housewives, Yeah, and they're like, I
[16:41] Speaker 2: remember it was in Emily said I'm going to kill you. Yeah,
[16:44] Speaker 2: and then they pull it up in court.
[16:45] Speaker 1: Yeah, that would be great. I would love to contribute
[16:48] Speaker 1: in any way possible. December twenty fourth two or in
[16:52] Speaker 1: the morning, he talks about Martha Stewart living After approximately
[16:56] Speaker 1: nine forty eight am, Scott leaves the couple's home and
[16:59] Speaker 1: drives to his where house located about three miles away.
[17:02] Speaker 1: We're going to talk about this timeline and the timeline
[17:04] Speaker 1: and trial because the timeline, Yeah, well and part two
[17:07] Speaker 1: we're going to pick up our turt right now. I know,
[17:09] Speaker 1: but right now we're just going to go with what
[17:11] Speaker 1: the prosecution alleges.
[17:13] Speaker 2: So we're kind of going in chronological order of how
[17:15] Speaker 2: the evidence is being surfaced and everything.
[17:17] Speaker 1: They claim that he left prior to ten in the morning,
[17:20] Speaker 1: because I believe when he gets to work his work
[17:23] Speaker 1: computer he's logged on I think at like ten oh
[17:26] Speaker 1: eight or something like that, and his office is very
[17:29] Speaker 1: close by his home. So the timeline is suggesting that
[17:33] Speaker 1: he probably I think the Martha Stewart episode where they
[17:36] Speaker 1: said Meringue was nine forty eight, but then he logs
[17:38] Speaker 1: into his work computer at ten oh eight, So you
[17:41] Speaker 1: can you can give.
[17:42] Speaker 2: Twenty minutes is not reasonable for him to go from?
[17:45] Speaker 1: No, it is? It is, So I'm saying.
[17:47] Speaker 2: He can't add up.
[17:48] Speaker 1: Then well, yeah, he probably leaves the house at nine
[17:53] Speaker 1: point fifty and then he gets to work at ten.
[17:55] Speaker 1: But they have They're very stuck on that timeline because
[17:58] Speaker 1: for the prosecution, they claim that she was murdered prior
[18:02] Speaker 1: to that time. That's the how Scott's guilty. Right. She
[18:06] Speaker 1: has to be dead before he leaves for work.
[18:09] Speaker 2: Right, because he logged into his computer. That was the
[18:11] Speaker 2: alibi for where he was at that time. Thus the
[18:13] Speaker 2: murder had to take place prior to if it was him.
[18:18] Speaker 1: Also, on December twenty fourth, this is approximately at ten
[18:21] Speaker 1: eighteen am, the neighbor Karen Service, finds Mackenzie the dog
[18:26] Speaker 1: wandering outside with his leash still attached. She returns the
[18:30] Speaker 1: dog to the Peterson's yard.
[18:32] Speaker 2: What time is this again?
[18:32] Speaker 1: This is at ten eighteen. She claims it's ten eighteen,
[18:35] Speaker 1: and the prosecution goes with her timeline again. I'm going
[18:38] Speaker 1: to say this probably five million times. There are other
[18:41] Speaker 1: witnesses that we're going to talk about in part two
[18:44] Speaker 1: that might pick apart this timeline. But as for today's purpose,
[18:48] Speaker 1: based upon a receipt that she had and some other
[18:50] Speaker 1: things going on, she narrows it down to about ten
[18:53] Speaker 1: eighteen that she finds the dog with the leash attached. Also,
[18:56] Speaker 1: by the way, I don't know if this was in
[18:58] Speaker 1: the original trial or not, but the leash is found
[19:02] Speaker 1: wet and with lots of pieces of grass on it,
[19:04] Speaker 1: which would mean that the dog.
[19:06] Speaker 5: Well at least went through some grassy area, right, Not
[19:09] Speaker 5: that the dog, Not that Lacey had had the dog
[19:12] Speaker 5: and put the leash on and then maybe ran back
[19:14] Speaker 5: in the house really quickly to get something, and the
[19:16] Speaker 5: dog was only briefly there that Scott Peterson put the
[19:20] Speaker 5: leash on the dog and set the dog loose. Well
[19:23] Speaker 5: wait a minute, but why couldn't the dog by itself
[19:25] Speaker 5: go through a gag grassy field.
[19:28] Speaker 1: It could. I'm not saying that she took the dog
[19:31] Speaker 1: through the grassy field. I'm just saying that its significant
[19:35] Speaker 1: that the leash is wet and has grass stuck all
[19:37] Speaker 1: over it, which means that the dog had been probably
[19:40] Speaker 1: out somewhere, not just left briefly in front of the house.
[19:44] Speaker 1: That's all I'm saying right now, all right, all right,
[19:47] Speaker 1: So the dog is found with the leash still attached.
[19:49] Speaker 1: Now December twenty fourth of two thousand and two. Now
[19:52] Speaker 1: we get to approximately ten thirty to eleven am. Computer
[19:56] Speaker 1: activity places Scott at his warehouse where he reads and
[20:00] Speaker 1: sends emails. He then attaches his fishing boat to his
[20:03] Speaker 1: truck and drives roughly ninety miles to the Berkeley Marina.
[20:07] Speaker 1: Now that's another question I have, and a lot of
[20:09] Speaker 1: people question this, and this is why a lot of
[20:11] Speaker 1: people think that he was guilty if you're going to
[20:13] Speaker 1: go fishing, because he claims that he only takes the
[20:15] Speaker 1: fishing boat out. This is a very small fishing boat.
[20:17] Speaker 1: If you've seen a picture of it, it's it's just
[20:19] Speaker 1: like a little like ten fishing boat blow ten. I
[20:24] Speaker 1: don't know. It's great aluminum.
[20:26] Speaker 2: It's ten ten ten ten T I number no ten
[20:30] Speaker 2: t N like a just small little fishing boat.
[20:35] Speaker 1: It doesn't have a cover.
[20:36] Speaker 2: You know, it's not something you would go out with
[20:38] Speaker 2: your girlfriends on.
[20:39] Speaker 1: Not with your with your No. I would suggest don't
[20:42] Speaker 1: go out in as an old right, Yeah, right December
[20:48] Speaker 1: twenty fourth of two, twelve fifty four pm, a parking
[20:51] Speaker 1: receipt places Scott at the Berkeley Marina. He later says
[20:54] Speaker 1: he took the boat out to test it and fish
[20:57] Speaker 1: near Brooks Island approximately between one and two pm. Scott
[21:03] Speaker 1: says he fishes in San Francisco Bay, and prosecutors would
[21:06] Speaker 1: later emphasize that Lacy and Connor's remains were eventually found
[21:10] Speaker 1: close to this area. All Right, around two fifteen pm,
[21:13] Speaker 1: Scott calls the Peterson home and Lacy's cell phone. He
[21:17] Speaker 1: leaves a message saying he is leaving Berkeley and asked
[21:19] Speaker 1: Lacy to pick up a holiday gift basket. I have
[21:22] Speaker 1: listened to this voicemail. He's very, very very sweet. Now
[21:28] Speaker 1: here's the question, go k salved. Well, here's the question.
[21:32] Speaker 1: Is she already dead and he knows that she's dead,
[21:34] Speaker 1: so he's establishing an alibi by calling and leaving a voicemail,
[21:38] Speaker 1: or is she not dead? He has no idea she's
[21:40] Speaker 1: dead and he's just being and playing the doting husband
[21:43] Speaker 1: that's having an.
[21:44] Speaker 2: Affair that she has hearst of. That is, does he
[21:46] Speaker 2: normally leave messages to her? Well, if I left a
[21:50] Speaker 2: message for you. That would be weird.
[21:52] Speaker 1: It would be very weird.
[21:53] Speaker 2: On well, we do texting now, but that that's what
[21:56] Speaker 2: I'm saying. Out of the ordinary.
[21:57] Speaker 1: Well, he calls and leaves a message, and he calls
[21:59] Speaker 1: her sweet and he's like, if you called left me
[22:02] Speaker 1: a voicemail and you called me sweetie, there's a serious
[22:05] Speaker 1: problem that you've done something wrong. You're up to no good.
[22:09] Speaker 1: Then we get to approximately four thirty pm. Scott returns
[22:13] Speaker 1: to his warehouse, leaves the boat there, and drives home.
[22:16] Speaker 1: He says that he finds Lacey's car in the driveway,
[22:18] Speaker 1: the front door unlocked, and Mackenzie is in the yard
[22:21] Speaker 1: with the leash still attached. Later in that afternoon, Scott
[22:25] Speaker 1: puts his clothes in the washing machine, eats leftover pizza,
[22:27] Speaker 1: and takes a shower before contacting Lacey's family. He later
[22:31] Speaker 1: says he initially assumed that she was at her mother's house.
[22:34] Speaker 1: Then by five seventeen pm, this is still on Christmas Eve,
[22:38] Speaker 1: Scott calls Sharon Rocha and learns that Lacey is not
[22:40] Speaker 1: with her family. He tells Sharon that Lacey is missing.
[22:44] Speaker 1: Five forty seven pm, Lacey's stepfather, Ron Grantsky calls nine
[22:48] Speaker 1: one one and reports that eight month pregnant Lacey has disappeared.
[22:52] Speaker 1: Approximately six pm, the Mowdesto Police begins searching East Laloma Park,
[22:57] Speaker 1: where Lacey reportedly walked the dog Anna's Sam In the
[23:00] Speaker 1: Peterson home. Investigators find no obvious signs of forced entry
[23:04] Speaker 1: or a violent struggle. December twenty fourth to the twenty
[23:09] Speaker 1: fifth police search the home, Scott's truck, and his warehouse.
[23:13] Speaker 1: Scott voluntarily participates in a videotaped interview shortly after midnight
[23:17] Speaker 1: and initially says he is willing to take a polygraph.
[23:20] Speaker 1: He later declines on his father's advice. Let me just
[23:24] Speaker 1: say a little bit about this taped interview. They show
[23:27] Speaker 1: this interview all the time. Anytime you watch a Lacy
[23:29] Speaker 1: Peterson Scott Peterson documentary, they show this interview of its
[23:34] Speaker 1: detective Brokini interviewing Scott about Lacey, what he did that day,
[23:40] Speaker 1: he went fishing, all those things. Scott looks like the
[23:44] Speaker 1: biggest doucher in this interview because his wife is missing.
[23:48] Speaker 1: At this point, no one knows where she is. She
[23:51] Speaker 1: hasn't been seen, she's eight months pregnant. They interview him
[23:55] Speaker 1: it's on video tape. I've seen it multitudes of times.
[23:59] Speaker 1: He's completely relaxed. He shows no emotion, stoic kind of huh, well,
[24:05] Speaker 1: I mean stoic. He's disengaged, disassociative, whatever you want to
[24:11] Speaker 1: call it. Like, he doesn't seem to give a carer
[24:13] Speaker 1: in the world. That is pregnant wife of eight months
[24:16] Speaker 1: is missing and no one can find her.
[24:18] Speaker 2: I can picture that. I remember that Scott Peterson used
[24:22] Speaker 2: the word missing immediately when calling his mother in law Sharon,
[24:25] Speaker 2: on Christmas Eve in two thousand and two, which Sharon
[24:29] Speaker 2: testified felt like a premature and suspicious choice of language
[24:34] Speaker 2: when he called her.
[24:35] Speaker 1: Okay, but listen, if you come home and you can't
[24:38] Speaker 1: find me and you don't know where I am, you
[24:39] Speaker 1: wouldn't call my sister and say Emily is missing.
[24:42] Speaker 2: No, your sister lives in Ohio. How that can help me?
[24:45] Speaker 2: This is this? Nope, you have to make it apples
[24:48] Speaker 2: and apples. If you don't hear from me from ten
[24:51] Speaker 2: o'clock until five o'clock, right, I don't respond or anything,
[24:57] Speaker 2: and then you want to know where I am because
[24:59] Speaker 2: you want to get mad at me for something, Right,
[25:01] Speaker 2: then you call my parents, Do you say Shane is
[25:05] Speaker 2: missing or I can't. I haven't heard from him. I
[25:08] Speaker 2: can't find him. Have you heard from him? Do you
[25:10] Speaker 2: know where he is? You don't say Shane is missing.
[25:14] Speaker 2: That's not that's not true. It's not missing. He's not
[25:16] Speaker 2: missing yet.
[25:17] Speaker 1: Maybe I would say Shane is missing because you're always here.
[25:20] Speaker 1: If you're always here and you're not here, you're missing.
[25:22] Speaker 1: I probably would call your mom and go, Shane is missing.
[25:27] Speaker 1: I don't know. I don't know, stucking up, Shane is missing.
[25:32] Speaker 1: Let me ask you a question. Though he initially says
[25:34] Speaker 1: in the interview that he will take a polygraph, and
[25:36] Speaker 1: then he goes, it's accurate, right, he asked the detective,
[25:39] Speaker 1: and the detectives like, well, yeah, I mean, I guess, yeah,
[25:41] Speaker 1: it's accurate.
[25:42] Speaker 3: You know.
[25:43] Speaker 1: Would you advise him if you were his attorney, would
[25:45] Speaker 1: you advise him to take a polygraph?
[25:47] Speaker 2: No?
[25:48] Speaker 1: Well, he then he declines later I believe after he
[25:50] Speaker 1: talks to his dad and he just declined a polygraph,
[25:53] Speaker 1: I would not. Yeah, would you take a polygraph if
[25:56] Speaker 1: I was missing?
[25:58] Speaker 2: Do I have anything to do with it? Because that
[26:01] Speaker 2: changes my answer.
[26:05] Speaker 6: Dancing with the Stars is looking for a new pro,
[26:08] Speaker 6: and since last season I came in eighth place. I'm
[26:11] Speaker 6: basically an expert easy there.
[26:14] Speaker 7: I've spent my entire life in the ballroom, so maybe
[26:16] Speaker 7: you could use some help. I'm Danielle Fischer and I'm Vouchmerkovsky,
[26:20] Speaker 7: and we have.
[26:20] Speaker 6: A new podcast called Stepping on Toes with Danielle and vow.
[26:24] Speaker 7: Every week we're breaking down Dancing with the Stars the

[26:41] Speaker 7: It's time to crown a new Dancing with the Stars pro.
[26:44] Speaker 7: So let us be your guys through this once in
[26:45] Speaker 7: a lifetime opportunity.
[26:47] Speaker 1: Do you think I could win?
[26:48] Speaker 2: No?
[26:49] Speaker 6: Listen to Stepping on Toes on the iHeartRadio app, Apple
[26:52] Speaker 6: Podcasts or wherever you get your podcasts.
[27:01] Speaker 1: Now December twenty six, so we get to the day
[27:03] Speaker 1: after Christmas as Search headquarters opens at the Red Lion Hotel.
[27:07] Speaker 1: Volunteers conduct extensive searches by foot, horseback and boat. December
[27:12] Speaker 1: twenty six, of two thousand and two, a home across
[27:14] Speaker 1: the street from the Peterson residence is burglarized. The defense
[27:18] Speaker 1: later argues that the burglary could be connected to Lacey's disappearance,
[27:21] Speaker 1: and police arrest the burglars and conclude the crime occurred
[27:25] Speaker 1: on December twenty six and was unrelated, although the timing
[27:29] Speaker 1: and possible connection remained disputed by Peterson's supporters. Again, I
[27:35] Speaker 1: will say that I do not think in any way,
[27:38] Speaker 1: shape or form that this burglary took place on December
[27:41] Speaker 1: twenty six. There's no way. By this point Lacey had
[27:45] Speaker 1: been missing for two days, which means that her entire
[27:49] Speaker 1: street is full of police, police, investigators, caution, tapets, reporters.
[27:57] Speaker 1: You're gonna tell me that with all that police presence
[28:01] Speaker 1: and all those reporters, and they.
[28:02] Speaker 2: Probably would rather steal all the Christmas presents under the
[28:05] Speaker 2: tree on the twenty fourth rather than on twenty six,
[28:07] Speaker 2: and they have to go find it exactly.
[28:09] Speaker 1: So, you cannot convince me that that happened on December
[28:12] Speaker 1: twenty sixth. It happened on December twenty fourth. But we
[28:14] Speaker 1: will talk about that more or later. Part two, Part two.
[28:17] Speaker 1: On December twenty ninth of O two, Fresno police officer
[28:20] Speaker 1: Richard Byrd tells Amber that the Scott Peterson she is
[28:23] Speaker 1: dating appears to be the husband of the missing Modesto woman.
[28:28] Speaker 1: Amber then contacts Modesto police and meets with detectives Al
[28:32] Speaker 1: Brokini and John Buehler. She provides photographs, gifts, and details
[28:36] Speaker 1: establishing her relationship with Scott. At investigator's requests, she agrees
[28:41] Speaker 1: to secretly record future conversations with him. Then, on December
[28:45] Speaker 1: thirtieth of two, Scott hires attorney Kirk McAllister. While the
[28:49] Speaker 1: missing person investigation is underway, you know, it's also there's
[28:54] Speaker 1: so much footage of everyone looking for Lacey, and I
[28:58] Speaker 1: don't know if Scott was really involved in a lot.
[29:02] Speaker 2: He didn't go to the memorial thing or the thing
[29:04] Speaker 2: where they hold candles.
[29:05] Speaker 1: Yeah, you know, it's not a good look for him.
[29:07] Speaker 1: I don't feel like he I think nothing.
[29:11] Speaker 2: Nothing is a good look for this guy.
[29:13] Speaker 1: You keep saying that, you know, and he avoids the
[29:15] Speaker 1: media in the beginning, he doesn't answer questions. Not a
[29:17] Speaker 1: good look for him. And then when he does decide
[29:20] Speaker 1: that he's going to go in front of the media
[29:22] Speaker 1: and do interviews and answer questions. Horrible, horrible look for
[29:27] Speaker 1: him awful.
[29:28] Speaker 2: Well, then then I know we're fast forwarding. But then
[29:30] Speaker 2: he tries to run away, doesn't He bleach his hair
[29:32] Speaker 2: and get a bunch of cash and he goes to
[29:34] Speaker 2: the border. It's like, dude, this guy.
[29:37] Speaker 1: He does he does? Yeah, I don't know, though. You
[29:39] Speaker 1: could look at that two ways. You could look at
[29:41] Speaker 1: it like he already knows the police have honed in
[29:42] Speaker 1: on him, and that you.
[29:44] Speaker 2: Can always look at it like you're running because you're innocent.
[29:46] Speaker 2: I get it.
[29:47] Speaker 1: But yeah, I'm just saying be open minded. On January
[29:51] Speaker 1: sixth of two thousand and three, Scott does admit to
[29:53] Speaker 1: Amber that he has not been traveling overseas and that
[29:55] Speaker 1: his pregnant wife has disappeared. On Christmas Eve, Amber confronts
[29:59] Speaker 1: him about why he previously said he had already lost
[30:02] Speaker 1: his wife, and Scott does not provide a clear explanation
[30:05] Speaker 1: or confess to harming Lacey. You know, she records all
[30:09] Speaker 1: these conversations thinking that at some point she's going to
[30:11] Speaker 1: get some kind of evidence where he's going to admit
[30:13] Speaker 1: to her that like he did, something to Lacy, but
[30:15] Speaker 1: he never does.
[30:16] Speaker 2: You know.
[30:16] Speaker 1: My favorite though, is when he pretends to be in Paris.
[30:19] Speaker 1: He tells her that he's been traveling across Europe.
[30:21] Speaker 2: I guess something.
[30:23] Speaker 1: Yeah, and he's like, I'm and he's like talking to
[30:25] Speaker 1: her and he's like, I'm looking at the Eifel.
[30:28] Speaker 2: Fertilizer in Paris.
[30:30] Speaker 1: Yeah.
[30:31] Speaker 2: I was like, my gosh, why would he do that?
[30:34] Speaker 2: Is he trying to say he's romantic without her? Like,
[30:36] Speaker 2: I don't get it?
[30:37] Speaker 1: Well, I think he can't see her because the police
[30:39] Speaker 1: are looking for his wife, so he has to come
[30:41] Speaker 1: up with a reason why they can't get together. So
[30:43] Speaker 1: he tells her he's traveling in Europe. So he keeps
[30:46] Speaker 1: calling her to keep this relationship going, but he can't
[30:50] Speaker 1: physically see her because he's supposed to be looking for
[30:53] Speaker 1: his wife, right right, And he can't get caught with
[30:56] Speaker 1: his I mean, he's got the media all over him.
[30:58] Speaker 1: They'reollowing him every where he goes. So he tells her
[31:00] Speaker 1: he's traveling Europe and he's looking at the house.
[31:03] Speaker 2: Do not think that Amber Frey's going to see him
[31:05] Speaker 2: on TV?
[31:07] Speaker 1: I don't know. I'm not saying the guy's bride and.
[31:09] Speaker 2: It's not a good look. It's not a good look
[31:11] Speaker 2: for him, not a good look.
[31:14] Speaker 1: January twenty, third of three, Amber publicly reveals that she
[31:17] Speaker 1: began dating Scott after he told her that he was unmarried.
[31:20] Speaker 1: She explains that she immediately contacted the police after learning
[31:24] Speaker 1: of Lacey's disappearance. Lacey's family announces that it has learned
[31:29] Speaker 1: of Scott's affair, and family members who had initially defended him,
[31:33] Speaker 1: they withdraw their public support. They withdraw their support, like
[31:37] Speaker 1: on camera, they made sure they made a thing out
[31:39] Speaker 1: of it. They basically go up into a press conference
[31:42] Speaker 1: and say, we no longer support Scott Peterson.
[31:45] Speaker 2: Would you, I mean, was your son in law?
[31:49] Speaker 1: I don't. I don't know what I would do. I
[31:51] Speaker 1: don't know. I've never been in a situation like that.
[31:53] Speaker 1: I don't, I don't know. I mean, I wouldn't be.
[32:00] Speaker 2: He's county, so it's hard for you to say that's
[32:02] Speaker 2: what you would do.
[32:05] Speaker 1: So yeah, yes, all right, he doesn't, like I said,
[32:09] Speaker 1: He initially avoids all media contact. He doesn't do interviews,
[32:11] Speaker 1: he doesn't talk to anyone, he declines comments. He's always
[32:15] Speaker 1: you know, they show everyone out searching. He's like on
[32:17] Speaker 1: the outskirts or not there. He's not involved. He doesn't
[32:19] Speaker 1: look like he cares. So I think they.
[32:21] Speaker 2: Sell his car too soon.
[32:23] Speaker 1: He sold her car, yeah, not soon, but it was,
[32:27] Speaker 1: you know, not a good look. It was before I
[32:29] Speaker 1: believe he sold I'm not sure when he sold her car,
[32:31] Speaker 1: but I think it was before the body was found.
[32:35] Speaker 1: On January twenty eighth of two thousand and three, Scott
[32:38] Speaker 1: does an interview with Diane Sawyer on Good Morning America.
[32:42] Speaker 1: He should have never done this interview.
[32:44] Speaker 2: Why why would you do an interview? Well, you know
[32:46] Speaker 2: why you would do an interview if you if you're innocent,
[32:48] Speaker 2: and you're trying to get the word out, and you're
[32:50] Speaker 2: really trying to get exposure so hopefully you get some
[32:53] Speaker 2: leads and stuff.
[32:54] Speaker 1: No. I think that because so many people were telling
[32:56] Speaker 1: him that he looks so bad in the press and
[32:58] Speaker 1: in the media, that maybe he sho should.
[33:01] Speaker 2: You should go in Good Morning America and look bad.
[33:03] Speaker 2: I'm terrible for the press.
[33:05] Speaker 1: He denies murdering Lacey or having anything to do with
[33:09] Speaker 1: her disappearance. However, this is so ridiculous. I can't believe
[33:13] Speaker 1: he did that. He claims that Lacey knew about the
[33:16] Speaker 1: affair with Amber Fry and that she was okay with it.
[33:20] Speaker 1: I was like, oh my gosh, why would you say
[33:23] Speaker 1: something like that.
[33:25] Speaker 2: And then they always say that, They always say like, oh, yeah,
[33:28] Speaker 2: we were kind of separating. They kind of knew.
[33:31] Speaker 1: No, but he doesn't claim that they were like separated right.
[33:33] Speaker 2: Now, but they always kind of Oh, this is even worse.
[33:35] Speaker 2: He's like, he.
[33:36] Speaker 1: Claims that, like she knew about it, she was okay
[33:38] Speaker 1: with it. She's eight months pregnant. She's fine with him
[33:40] Speaker 1: having an affair with somebody else.
[33:42] Speaker 2: Most couples watch Martha Stewart and then he can go golfing,
[33:46] Speaker 2: fishing and screws someone on the side.
[33:48] Speaker 1: Right, Yes, he you know, I don't. He needed a
[33:53] Speaker 1: media consultant, He needed someone to help him before he
[33:57] Speaker 1: did this interview.
[33:59] Speaker 2: Don't go into me, or he needed.
[34:01] Speaker 1: To just not say anything. He needed to stick with
[34:02] Speaker 1: the not talking to the media because going in front
[34:05] Speaker 1: of Diane Sawyer and answering questions about an affair, but
[34:09] Speaker 1: then saying that Lacey was fine with the affair and
[34:11] Speaker 1: she was cool with it, and then when Diane pressed
[34:13] Speaker 1: him on it and he said, well, you just don't
[34:15] Speaker 1: know our relationship. You sound like an idiot, a complete idiot.
[34:19] Speaker 1: You sound like a liar.
[34:20] Speaker 2: Not a good look.
[34:21] Speaker 1: It's not a good look. Early in two thousand and three,
[34:25] Speaker 1: investigators monitor Scott as he makes several trips to the
[34:28] Speaker 1: Berkeley Marina, authoritizing his vehicle. I think, right, oh, yeah,
[34:31] Speaker 1: they had trackers on him. Yeah. Authorities conduct searches of
[34:34] Speaker 1: the bay, but initially failed to locate Lacey so this
[34:40] Speaker 1: she disappeared on December twenty fourth. On April thirteenth of
[34:42] Speaker 1: two thousand and three, following a storm, the remains of
[34:46] Speaker 1: a male fetus are discovered along the San Francisco Bay
[34:49] Speaker 1: shoreline in Richmond on April fourteenth. The following day, the
[34:53] Speaker 1: decomposed torso of an adult woman is found nearby. The
[34:57] Speaker 1: body is missing its head, forearms, and lower legs. Investigators
[35:01] Speaker 1: note that both sets of remains washed ashore near the
[35:04] Speaker 1: area where Scott said he had gone fishing. Autopsies and
[35:09] Speaker 1: DNA testing identify the remains as Lacey and Connor, and
[35:13] Speaker 1: because of the condition of Lacey's body, examiners cannot conclusively
[35:17] Speaker 1: determine precisely when, where or how she died, and that
[35:22] Speaker 1: is a theme that will carry all the way into trial.
[35:25] Speaker 1: There is no evidence. I just want to reiterate this.
[35:28] Speaker 1: There is no evidence, no DNA, no forensics that can
[35:34] Speaker 1: identify how she died, when she died, where she died.
[35:39] Speaker 1: In April of two thousand and three, forensic pathologist doctor
[35:42] Speaker 1: Brian Peterson concludes that Connor died in Utero and was
[35:46] Speaker 1: likely expelled from Lacey's body after her death. He finds
[35:50] Speaker 1: no indication that Connor was naturally delivered or removed by
[35:53] Speaker 1: cesarean section. All right, so now we get to the
[35:57] Speaker 1: arrest of Scott Peterson on April eighteenth, the two thousand
[36:01] Speaker 1: and three police follow Scott into San Diego as he
[36:04] Speaker 1: drives toward Tory Pines golf Course, where.
[36:06] Speaker 2: It's an hour four months later or four months later,
[36:09] Speaker 2: Modesto and San Diego. It's a little bit of a drive.
[36:12] Speaker 1: It's like eight hours, right, because it we're Modesto's up
[36:15] Speaker 1: by the San Francisco.
[36:16] Speaker 2: Up towards that direction, Amita, how far up.
[36:18] Speaker 1: And now we're getting down to San Diego. It might
[36:19] Speaker 1: even be longer than eight hours, maybe that's nine.
[36:21] Speaker 2: Either way, it's now meaning it's not just like the
[36:24] Speaker 2: county next door.
[36:24] Speaker 1: It's like right, right, they issue an arrest warrant for
[36:30] Speaker 1: him for murder, but they they're tracking him, and they
[36:34] Speaker 1: track him in San Diego.
[36:37] Speaker 2: They probably saw it as fleeing, and so they quickly
[36:41] Speaker 2: right got an arrest warrant.
[36:43] Speaker 1: Right because he's getting close to Mexico. Right after Scott
[36:46] Speaker 1: attempts to evade the vehicles following him, officers arrest him.
[36:50] Speaker 1: This is on April eighteenth. Of three authorities find approximately
[36:55] Speaker 1: fifteen thousand dollars in cash, four cell phones, camping supplies,
[37:00] Speaker 1: his brother's identification, a map to Amber's workplace. His hair
[37:05] Speaker 1: and goateee have been dyed blonde. Prosecutors and the media
[37:08] Speaker 1: characterized these circumstances as evidence that he may have planned
[37:12] Speaker 1: to flee. Scott's family says he changed his appearance to
[37:15] Speaker 1: avoid reporters and possessed the other items for innocent reasons.
[37:21] Speaker 1: I don't know, I mean, maybe he was planning to flee.
[37:23] Speaker 2: Where did they catch him though? It wasn't he golfing?
[37:25] Speaker 1: Well, they claimed that he was supposed to meet, you know,
[37:27] Speaker 1: his family to play golf at the Tory Pines golf course.
[37:30] Speaker 2: Uh huh do you know? Did they just pull him over?
[37:33] Speaker 1: Yeah, and arrest him. But he was driving somebody else's vehicle.
[37:36] Speaker 1: He wasn't driving his own. He was driving like some
[37:38] Speaker 1: older two seater Mercedes. Obviously he's trying to avoid. I mean,
[37:43] Speaker 1: I understand he's probably trying to avoid not only police,
[37:45] Speaker 1: but also he's trying to evade. I'm sure he's followed
[37:48] Speaker 1: everywhere by reporters too. Yeah, I mean, this guy can't
[37:52] Speaker 1: He can't go golf at Tory Pine's golf course without
[37:55] Speaker 1: having a media frenzy following him everywhere he's going. While
[37:59] Speaker 1: detect his transport Scott back to Modesto, they receive confirmation
[38:03] Speaker 1: that the remains belong to Lacy and to Connor. Scott's
[38:07] Speaker 1: response is later described by investigators as limited. I don't know.
[38:11] Speaker 1: I don't think he shows much emotion once he knows
[38:13] Speaker 1: that it's confirmed that it's his wife and son that
[38:15] Speaker 1: have been found in the bay. I don't think he
[38:18] Speaker 1: shows that's a big thing, like.
[38:20] Speaker 2: One way or another. Like he's not feeling like, hey, okay,
[38:23] Speaker 2: well I'm glad we found her body. We can now
[38:26] Speaker 2: investigate further. And it's not even sadness that she's dead.
[38:30] Speaker 1: Right, No, he doesn't show much emotion ever since the
[38:33] Speaker 1: day she disappeared. But then, you know, sometimes I think
[38:36] Speaker 1: if someone if I was missing and someone interviewed you
[38:39] Speaker 1: about me missing, I don't know if you would show
[38:42] Speaker 1: a lot of emotion either, because you're not a very
[38:44] Speaker 1: emotional person. But that doesn't mean you're guilty.
[38:49] Speaker 2: No, that was a very nice thing to say.
[38:53] Speaker 1: Well, I'm just saying, like, you're not the kind of
[38:55] Speaker 1: guy that's going to be like weeping and crying and
[39:00] Speaker 1: like throwing yourself on the ground, and like why why I.
[39:03] Speaker 2: Don't know any guy that would do that in media
[39:06] Speaker 2: if their wife is missing, throw themselves on the ground.
[39:09] Speaker 1: I don't know. I'm just saying, you're not going to
[39:10] Speaker 1: make a big emotional You're not going to look emotional.
[39:13] Speaker 1: I just know you. You just you don't show a lot
[39:15] Speaker 1: of emotion sometimes. So I'm just saying, if I disappeared
[39:18] Speaker 1: and they interviewed you, I.
[39:20] Speaker 2: Might show some emotions.
[39:21] Speaker 1: Oh yeah, all right. Scott is arraigned on two murder charges.
[39:26] Speaker 1: He is charged with first degree murder in Lacy's death
[39:29] Speaker 1: and second degree murder in Connor's death. Prosecutors announced that
[39:32] Speaker 1: they will seek the death kind of.
[39:33] Speaker 2: You know, if I didn't show emotions.
[39:35] Speaker 1: Oh we're back to that again.
[39:36] Speaker 2: Okay, it wouldn't work really too much against me, you
[39:41] Speaker 2: know I because I also didn't go fishing where your
[39:46] Speaker 2: body was found. I didn't have an affair that I'm
[39:50] Speaker 2: saying is so stupidly recognized by you and is okay
[39:53] Speaker 2: by you. You know. I wouldn't have any of those things.
[39:57] Speaker 1: I get it. You're so you could and that.
[40:00] Speaker 2: Would be one thing, big deal.
[40:02] Speaker 1: Right, Okay, so you're allowed to have a lack of emotion.
[40:05] Speaker 1: Could you do anything else wrong? Scott's family hires high
[40:16] Speaker 1: profile defense attorney. Who does he hire? You know this?
[40:20] Speaker 2: He hires?
[40:24] Speaker 1: Come on, yes. Garago's team investigates possible sightings of Lacey
[40:32] Speaker 1: after Scott left home, and the burglary across the street,
[40:35] Speaker 1: and other alternative theories. April first of two thousand and four,
[40:40] Speaker 1: President George W. Bush signs the Federal Unborn Victims of
[40:43] Speaker 1: Violence Acts, sometimes called the Lacy and Connor's Law. The
[40:47] Speaker 1: legislation recognizes an embryo or fetus as a separate victim
[40:50] Speaker 1: when injured or killed during certain federal violent crimes. California
[40:54] Speaker 1: already had a fetal homicide law, under which Scott was
[40:57] Speaker 1: charged separately for Connor's death. All Right, he goes to jail,
[41:00] Speaker 1: or he goes to trial in January of two thousand
[41:03] Speaker 1: and four.
[41:03] Speaker 2: Okay, if he's found not guilty and he's now has charged,
[41:07] Speaker 2: his conviction is reversed, does that make Garrogos look like
[41:11] Speaker 2: a bad attorney? Is that not a good look for him?
[41:15] Speaker 1: What do you mean?
[41:16] Speaker 2: Well, just in general, if let's say, let's say evidence
[41:19] Speaker 2: now surfaces. Yeah, let's say I don't know, there's a
[41:22] Speaker 2: retrial or a mini trial or some appeal or something
[41:26] Speaker 2: where now it's like, you know what, Scott Peterson, there
[41:28] Speaker 2: is doubt, well that.
[41:29] Speaker 1: Is going on right now, the project is according.
[41:32] Speaker 2: To that's the that's the court order. They reverse it.
[41:37] Speaker 2: Does that make his defense attorney look bad?
[41:40] Speaker 1: Well? I think that Gargos made some mistakes, that's for sure.
[41:43] Speaker 1: But I also when we get to part two, we
[41:45] Speaker 1: will talk about the fact that there was a lot
[41:47] Speaker 1: of evidence that the that the police suppressed that Gargos
[41:52] Speaker 1: was not privy.
[41:52] Speaker 2: To Okay, Okay, So that's more of a legal administrative matter.
[41:57] Speaker 1: A prosecutorial problem. Okay, And we'll get more to that,
[42:02] Speaker 1: all right. In January two thousand and four, Because of
[42:04] Speaker 1: extensive publicity in Modesto, the trial is transferred from Stanislaus
[42:09] Speaker 1: County to San Mateo County. Guerragos has requested Los Angeles,
[42:14] Speaker 1: but the court selects Redwood City. A jury selection takes place,
[42:18] Speaker 1: and prospective jurors are questioned extensively about media exposure, their
[42:23] Speaker 1: opinions of Scott, and their views on capital punishment. Look,
[42:26] Speaker 1: this case was so huge and it was so much
[42:28] Speaker 1: in the media. I don't know if change of venue
[42:30] Speaker 1: does anything to help Scott Peterson. I mean, I know
[42:33] Speaker 1: they're going to take it out of the Modesto ARAA.
[42:36] Speaker 2: That was probably defense wanting a more favorable venue. Maybe
[42:39] Speaker 2: he's more familiar with them, Maybe the peers will be
[42:42] Speaker 2: more lenient.
[42:43] Speaker 1: Maybe. June first of two thousand and four, Scott's trial
[42:46] Speaker 1: begins before Judge Alfred de Lucci. Prosecutor Rick Distasso argues
[42:51] Speaker 1: that Scott killed Lacy because he wanted freedom from the
[42:55] Speaker 1: marriage and from fatherhood. The prosecution theorizes that he killed
[42:59] Speaker 1: her at home in the morning, transported her body in
[43:02] Speaker 1: his boat, and then dumped her in the San Francisco
[43:05] Speaker 1: Bay using homemade concrete anchors. Garrigosa Hiss defense attorney argues
[43:11] Speaker 1: that Scott's adultery and lies do not make him a murderer.
[43:15] Speaker 1: That's very important because a lot of times when people
[43:18] Speaker 1: talk about Scott Peterson and they talk about how he's guilty,
[43:22] Speaker 1: I don't think anyone can actually articulate solid evidence as
[43:27] Speaker 1: to why they think he's guilty. Just everyone hates Scott Peterson,
[43:32] Speaker 1: so they put they hate that they have for Scott
[43:34] Speaker 1: Peterson and the fact that he had this affair with
[43:37] Speaker 1: Amber Fry and that he looks like a douchebag. That
[43:41] Speaker 1: doesn't equate murderer. Just wanted to put that out there.
[43:44] Speaker 2: Yeah, but you thought he was a murder at one
[43:45] Speaker 2: point for all those reasons.
[43:47] Speaker 1: I did until I until I've dug further into it,
[43:53] Speaker 1: which we will talk about.
[43:54] Speaker 2: At part two. In Part two, does you start to
[43:57] Speaker 2: look better? In part two?
[43:58] Speaker 1: Does what like?
[43:59] Speaker 2: So far? In part one? The theme is not a
[44:02] Speaker 2: good look?
[44:03] Speaker 1: Yeah?
[44:04] Speaker 2: Does he do anything that has a good look in
[44:05] Speaker 2: part two? Or is he still not a good look? Well?
[44:10] Speaker 1: No, I don't think he doesn't change his demeanor or
[44:12] Speaker 1: look better. I'm just saying in part two, there's a
[44:14] Speaker 1: lot of things that a lot of evidence that was
[44:16] Speaker 1: left out and that was suppressed, and I think that
[44:18] Speaker 1: we're going to dig into that and that you might
[44:21] Speaker 1: be more open minded and have an alternative viewpoint after
[44:25] Speaker 1: listening to other sides.
[44:26] Speaker 2: Sense right now life without parole?
[44:28] Speaker 1: Yes?
[44:29] Speaker 2: Is he doing anything to better himself in prison? Like
[44:31] Speaker 2: we learned with the Meninda's brothers, it regardless they were
[44:36] Speaker 2: pursuing education and reform and helping prisoners. Did he do
[44:40] Speaker 2: any of that? Because if not, it's not a good look.
[44:43] Speaker 1: He has long hair, I know that, and it hasn't
[44:45] Speaker 1: a ponytail.
[44:46] Speaker 2: Well, that doesn't equal murder, I know.
[44:48] Speaker 1: I'm just saying I don't know. Garrgos argues that Scott's
[44:52] Speaker 1: adultery and lies do not make him a murderer.
[44:55] Speaker 2: I have a comment on that. It doesn't make him
[44:58] Speaker 2: a murder. Yes, but it does and.
[45:00] Speaker 1: Help, No, it doesn't help.
[45:01] Speaker 2: It's not a good look.
[45:03] Speaker 1: No, it's not a good look. But the point is,
[45:04] Speaker 1: I think a lot of people, because they hate him
[45:07] Speaker 1: so much, it is hard to get past that hatred.
[45:09] Speaker 1: You just get to the point where you think he's
[45:11] Speaker 1: such a douchebag and such a terrible person, and he
[45:14] Speaker 1: comes off so horrible on camera that you just say
[45:18] Speaker 1: he did it without there being any evidence, no DNA,
[45:22] Speaker 1: no forensics, nothing linking him to it.
[45:25] Speaker 2: There's nothing showing him to be not guilty either, so far. Maybe.
[45:29] Speaker 1: In Part two, the defense emphasizes the absence of direct
[45:32] Speaker 1: forensic evidence establishing that Lacey was killed in the house, truck, warehouse,
[45:37] Speaker 1: or boat. There is no forensic evidence to prove that
[45:42] Speaker 1: she was killed in the house. There's no forensic evidence.
[45:46] Speaker 1: How did he do that? You're telling me he cleaned
[45:49] Speaker 1: four sights before the evening when he calls her mom
[45:53] Speaker 1: and tells her that she she's missing. He so he
[45:57] Speaker 1: manages to time. I ask you, no.
[45:59] Speaker 2: Did he Is there any record that he cleaned anything?
[46:03] Speaker 1: No?
[46:04] Speaker 2: Is there any record that he washed clothing or anything?
[46:08] Speaker 1: He did he washed his clothes, but maybe he always
[46:11] Speaker 1: washed his clothes. I don't know. Do you wash it?
[46:13] Speaker 1: You do laundry?
[46:14] Speaker 2: Yeah, I'm not Skott Peterson, all right, he he I
[46:19] Speaker 2: don't know. He watches Martha Stewart Living. Maybe he does
[46:22] Speaker 2: wash his clothes.
[46:22] Speaker 1: Yes. Juror Justin Falconer is questioned after making a comment
[46:26] Speaker 1: to Lacey's brother. He initially remains on the panel, but
[46:29] Speaker 1: is later removed after other jurors report that he discussed
[46:32] Speaker 1: evidence outside of the formal deliberations. This is on June
[46:35] Speaker 1: seventeenth of two thousand and four, after the trial started.
[46:39] Speaker 1: Prosecutors present evidence including Scott's undisclosed boat, the fishing license
[46:44] Speaker 1: is at Berkeley Marina, receipt, cell phone activity, concrete residue
[46:48] Speaker 1: at his warehouse, and his research into boats and bay currents.
[46:51] Speaker 1: Investigators also testify that Scott returned to the marina several
[46:55] Speaker 1: times after Lacey disappeared.
[46:57] Speaker 2: Ooh, why do he keep going to the marina? Maybe
[47:00] Speaker 2: he was fishing when his wife is missing.
[47:04] Speaker 1: Well, he's calling his girlfriend too when his wife is
[47:06] Speaker 1: missing and telling her, telling her that he's looking at
[47:10] Speaker 1: the Eiffel Tower. I'm just saying the prosecution experiences setbacks.
[47:16] Speaker 1: This is in the summer of two thousand and four.
[47:18] Speaker 1: During the trial, it incorrectly suggests that Scott lied about
[47:21] Speaker 1: watching a Martha Stewart segment involving meringue. The defense produces
[47:25] Speaker 1: the episode and confirms that the meringue was discussed. I
[47:28] Speaker 1: do know that when this trial first started, Garagos was
[47:32] Speaker 1: on a roll. I mean, he thought he was going
[47:35] Speaker 1: to win this thing.
[47:36] Speaker 2: I remember that he was media announcements.
[47:39] Speaker 1: He was taking out the prosecution right and left, and
[47:44] Speaker 1: it was looking good.
[47:46] Speaker 2: Add Peterson pay for this.
[47:48] Speaker 1: I think he has pretty wealthy parents.
[47:50] Speaker 2: Yeah.
[47:50] Speaker 1: They his parents retained Garagos because Garagos was going onto
[47:55] Speaker 1: Larry King Live. Because Larry King was always talking, like
[47:58] Speaker 1: every night they were talking about the Scott Peterson case,
[48:01] Speaker 1: and Gary Gos was always the you know, the guest,
[48:05] Speaker 1: the guest, the legal and he was always saying things
[48:10] Speaker 1: like there's no evidence. He was commenting on it, and
[48:15] Speaker 1: Scott Peterson's family watched it and liked that he was
[48:18] Speaker 1: always taking the position of there's not evidence, there's no DNA.
[48:24] Speaker 7: No.
[48:24] Speaker 1: I know they did. They reached out and hired him.
[48:27] Speaker 1: The defense produces the episode and confirms that meringue was discussed.
[48:32] Speaker 1: A police officer also gives testimony about Scott's behavior that
[48:35] Speaker 1: had not been properly disclosed to the defense. August tenth
[48:39] Speaker 1: of two thousand and four, Amber begins testifying jurors. Hear
[48:43] Speaker 1: about her relationship with Scott and listen to recorded calls
[48:46] Speaker 1: documenting his lies. Some jurors later say that the tapes
[48:49] Speaker 1: were important because they demonstrate his ability to manipulate others
[48:53] Speaker 1: and remain focused on Amber while Lacey was missing. You know,
[48:59] Speaker 1: amberfries that when she turned those tapes over to police
[49:03] Speaker 1: that she didn't have any idea that they were going
[49:04] Speaker 1: to be used in court, in open court, and that
[49:08] Speaker 1: I mean, I'm sure it was embarrassing for her for
[49:10] Speaker 1: those conversations to be publicly out there globally for everyone
[49:14] Speaker 1: to listen to their conversations. Detective Craig Grogan presents a
[49:19] Speaker 1: lengthy list of circumstances that investigators believe point to Scott.
[49:23] Speaker 1: They include his secret boat purchase, the marina, received fishing license,
[49:28] Speaker 1: bay research, concrete debris and limited early cell phone activity,
[49:31] Speaker 1: and repeated visits to the marina. Forensic pathologist doctor Brian
[49:37] Speaker 1: Peterson testifies about the condition of Lacy and Connor's remains.
[49:41] Speaker 1: He says Connor most likely died before being expelled from
[49:44] Speaker 1: Lacey's uterus, undermining the theory that Lacey gave birth while
[49:47] Speaker 1: being held captive by abductors. I do know that Lacey's
[49:54] Speaker 1: mother went to court every single day except for the
[49:57] Speaker 1: day that they talked about the condition of the remains.
[50:03] Speaker 1: Doctor Gregory DeVore estimates that Connor died honor around December
[50:08] Speaker 1: twenty third. Isn't that convenient that he just uses this information,
[50:13] Speaker 1: this chart from nineteen eighty four and he comes up
[50:15] Speaker 1: with this conclusion that Connor died on December.
[50:18] Speaker 2: Based on some evidence he saw as to the bot
[50:21] Speaker 2: and status of the body. He is some chart and
[50:24] Speaker 2: it leads to December twenty third.
[50:26] Speaker 1: Yes, I just find and he's the expert, and I'd
[50:29] Speaker 1: find that interesting. Defense expert doctor Charles March places Connor's
[50:34] Speaker 1: death several days later, but admits that his calculation relies
[50:37] Speaker 1: partly on assumptions and that fetal age cannot be determined
[50:40] Speaker 1: with complete certainty. Jury's later report finding DeVore that's the
[50:44] Speaker 1: first one. That's the prosecution's expert more credible. You know,
[50:50] Speaker 1: I don't even know. Sometimes I feel like, you know,
[50:53] Speaker 1: when you talk about junk science, like we've talked about
[50:55] Speaker 1: how bite marks have been used in the past to
[50:59] Speaker 1: convict someone one.
[51:00] Speaker 2: Well, in last week we talked about fire science, right,
[51:06] Speaker 2: and how now how that that was a wrongfully reported
[51:11] Speaker 2: origin of fire with arson accelerants versus electrical.
[51:15] Speaker 1: Right, So now when you look back on this fetal
[51:18] Speaker 1: age and being able to look at a body and
[51:21] Speaker 1: determine the gestational age. Obviously, the prosecution wants to establish
[51:28] Speaker 1: that Lacy and Connor died on December twenty third, because
[51:33] Speaker 1: if they died any later than December twenty third or
[51:36] Speaker 1: the twenty fourth, that means Scott Peterson didn't do it.
[51:39] Speaker 1: So it has to be the twenty fourth or twenty third,
[51:43] Speaker 1: And so to find an expert that says that based
[51:48] Speaker 1: upon I don't know, these are.
[51:51] Speaker 2: Really composed fetus right.
[51:54] Speaker 1: I don't know. To me, it seems more like junk science. Again.
[52:00] Speaker 1: November first of two thousand and four, closing arguments began.
[52:03] Speaker 1: Prosecutors stress that Scott placed himself at the bay on
[52:07] Speaker 1: the day Lacey disappeared, and that the body's surface near
[52:10] Speaker 1: his fishing location. They acknowledge that the exact manner of
[52:14] Speaker 1: death is unknown, but suggest strangulation or suffocation. He also
[52:21] Speaker 1: ran into people when he was there, so he so fishing. Yeah,
[52:26] Speaker 1: So they alleged that he takes his truck and he
[52:29] Speaker 1: puts the body in his truck. So he's got to
[52:31] Speaker 1: move the body from the house to the truck without
[52:34] Speaker 1: anyone seeing him, even though the neighbors see him in
[52:36] Speaker 1: the morning when he's outside.
[52:38] Speaker 2: Yeah, it's not like he has some remote home on
[52:40] Speaker 2: some property behind trees, right, So it's like a regular
[52:43] Speaker 2: neighborhood with homes across the street and right next door neighbor.
[52:46] Speaker 1: So he's got to get let's just think about this logically,
[52:49] Speaker 1: he's got to get a pregnant woman out of the
[52:52] Speaker 1: house and into the back of his truck. Then he's
[52:56] Speaker 1: got to drive his truck to his warehouse where he
[52:59] Speaker 1: keeps the boat. Now I saw the video of his warehouse.
[53:04] Speaker 1: There's a lot of businesses that are in this warehouse.
[53:07] Speaker 1: It's not just a loan warehouse. There's multiple doors like
[53:10] Speaker 1: garage doors, so he has a space, so there's lots
[53:13] Speaker 1: of other people that have space here. So he then
[53:16] Speaker 1: has to get the body out of his truck and
[53:19] Speaker 1: into the boat without anyone seeing him. Again, this is
[53:24] Speaker 1: just a shallow aluminum boat, not a ten. Then he's
[53:32] Speaker 1: got to drive the body in the boat ninety minutes
[53:37] Speaker 1: to a marina, and he doesn't go to.
[53:39] Speaker 2: Some remote Let me disagree with you. Why did he
[53:43] Speaker 2: have to put the body in the boat. I'm telling you.
[53:47] Speaker 2: I'm just saying, maybe you're the amount of transferring of
[53:50] Speaker 2: the body isn't as much as you think he puts
[53:52] Speaker 2: in it. It was a truck.
[53:53] Speaker 1: He has to put it in the boat. How does
[53:55] Speaker 1: he take it?
[53:55] Speaker 2: Let me finish my statement, lady. He put it in
[53:57] Speaker 2: the truck right then he drives and he connects the boat.
[54:00] Speaker 2: He didn't need to take it out yet. Then maybe
[54:03] Speaker 2: he went when he had a more secluded area that
[54:07] Speaker 2: he was in for taking it off the trailer. When
[54:10] Speaker 2: he's dipping the boat into the lake of the bay,
[54:13] Speaker 2: then he could have put it in there at that time.
[54:15] Speaker 1: But he goes to a highly populated place to put
[54:18] Speaker 1: his boat into the water. He's talking to other people
[54:20] Speaker 1: about fishing and what they caught that day. So I'm
[54:23] Speaker 1: saying the prosecution claims that the body is in the
[54:26] Speaker 1: boat November two. In two thousand and four, Garrigos argues
[54:29] Speaker 1: that there is no direct forensic evidence proving Lacey was
[54:32] Speaker 1: murdered in the Peterson home or transported in Scott's vehicle
[54:36] Speaker 1: or boat. He portrays the investigation as a rush to
[54:39] Speaker 1: judgment against an unfaithful husband. Now we get to the
[54:44] Speaker 1: deliberations and the verdict. So during the deliberations, jurors reviews
[54:47] Speaker 1: Scott's first police interview, examined his boat, and reconsidered the
[54:51] Speaker 1: prosecution's circumstantial case again circumstantial. Some jurors interpret his early
[54:58] Speaker 1: mention of grief, council, efforts to sell the house and
[55:02] Speaker 1: Lacy's vehicle, and addition of adult cable channels as signs
[55:06] Speaker 1: that he knew she would not return. I mean, he
[55:09] Speaker 1: did try to sell the house and he did sell
[55:11] Speaker 1: her car before she was found, So that is an indication.
[55:16] Speaker 1: You could look at it as an indication that he
[55:18] Speaker 1: knew that she was not coming back.
[55:20] Speaker 2: Not a good look.
[55:21] Speaker 1: Not a good look.
[55:22] Speaker 2: You know. I remember the one that made for TV
[55:24] Speaker 2: movie on this Yeah, who played Scott Peterson? No, Dean Kine.
[55:30] Speaker 1: Dean Kane.
[55:31] Speaker 2: I remember that? Oh really yeah, I watched. It was
[55:33] Speaker 2: a poorly dumb movie. I wouldn't recommend it.
[55:35] Speaker 1: No, well, there's a lot of documentaries on the documentaries.
[55:39] Speaker 1: Juror fran Gorman is removed after disclosing that she independently
[55:43] Speaker 1: researched a fishing website, and foreman Greg Jackson is later
[55:46] Speaker 1: replaced and eventually removed after reporting that he discussed the
[55:49] Speaker 1: case outside formal deliberations. Alternates to join the panel, requiring
[55:54] Speaker 1: deliberations to restart. On November twelfth of two thousand and four,
[55:59] Speaker 1: the jury Scott guilty of first degree murder for Lacey's
[56:02] Speaker 1: death and second degree murder for Connor's. The first degree
[56:05] Speaker 1: verdict reflects of finding that Lacy's murder was deliberate and premeditated.
[56:10] Speaker 1: Jurors select second degree murder for Connor because they find
[56:13] Speaker 1: insufficient evidence that Scott separately planned to kill him. After
[56:18] Speaker 1: a separate penalty phase, the jury recommends that Scott received
[56:22] Speaker 1: the death penalty. Judge Delucci formally sentence Scott to death
[56:28] Speaker 1: by lethal injection. This is on March sixteenth of two
[56:32] Speaker 1: thousand and five, and he is sent to San Quentin
[56:35] Speaker 1: State Prison, where I believe he is still today. And
[56:39] Speaker 1: as we discussed earlier, he is no longer sentenced to death,
[56:43] Speaker 1: that has been re sentenced to life in prison. All right,
[56:48] Speaker 1: we have gotten through Part one. All right, This concludes
[56:52] Speaker 1: part one of our analysis on the Scott and Lacy
[56:55] Speaker 1: Peterson case. Please listen to Part two exclusively and the
[56:59] Speaker 1: Legally Brunette feed for news on the Los Angeles Innocent
[57:03] Speaker 1: Projects petition to overturn Scott's conviction and what we can
[57:07] Speaker 1: expect to see next with this case. Also, I would
[57:11] Speaker 1: just like to reiterate that the Los Angeles Nosence Project
[57:16] Speaker 1: is a very respected innocence project that only takes cases
[57:22] Speaker 1: where they believe someone is factually innocent, not that there's
[57:29] Speaker 1: a reasonable doubt, not that they didn't have good defense counsel,
[57:35] Speaker 1: where they truly like the evidence that someone is factually innocent.
[57:42] Speaker 1: So we will get into that into part two, so
[57:45] Speaker 1: please make sure to listen to Scott Peterson Part two.
