[0:00] Speaker 1: The self-proclaimed fixer, Brown Mokotsi, also appearing in court today.
[0:04] Speaker 1: He's brought what is called a Section 205 application to
[0:08] Speaker 1: access the prosecutor's evidence against him to prepare for trial. Remember,
[0:12] Speaker 1: he was arrested for defeating the ends of justice, perjury,
[0:16] Speaker 1: unlawful possession of a firearm, ammunition. He's tried about 100
[0:19] Speaker 1: times to get bail. He keeps failing. Dimakatsu Lashoro, EWN
[0:23] Speaker 1: reporter on that case for us. Dimakatsu, good afternoon to you.
[0:27] Speaker 1: Take us through what's happening in the Brown-Mahoti matter.
[0:31] Speaker 2: Hi, Bendy. Indeed, he's brought an application where he wants
[0:35] Speaker 2: to know who the state's witnesses are to see the
[0:38] Speaker 2: evidence that's needed to challenge diversion. He's arguing that the
[0:43] Speaker 2: state cannot simply cite security concerns to keep the information
[0:49] Speaker 2: from the defense. As you know, the defense has disclosed
[0:52] Speaker 2: the docket, that is the information that they've got or
[0:54] Speaker 2: the evidence against him, but there are parts of that
[0:57] Speaker 2: evidence that have been redacted. And there is information of
[1:01] Speaker 2: some of the witnesses that's been withheld by the state,
[1:04] Speaker 2: and they've argued that that is for security concerns. But
[1:08] Speaker 2: he says in other matters, that would hold. But in
[1:11] Speaker 2: this instance, given A, that he's in custody, he's been
[1:15] Speaker 2: in custody since May this year, and he's not, you know,
[1:19] Speaker 2: been able to get bail. there's no chance of him
[1:22] Speaker 2: interfering with witnesses. So he wants the identity to know
[1:27] Speaker 2: the names, their details, their addresses, their cell phone records
[1:32] Speaker 2: to see what time they communicated. Does that align with
[1:36] Speaker 2: the time of the alleged shooting? As you know, this
[1:39] Speaker 2: is regarding the incident in a forced arrest last year
[1:42] Speaker 2: where he's alleged to have staged an assassination attempt on
[1:47] Speaker 2: his own life. as a result is facing perjury charges,
[1:52] Speaker 2: defeating the ends of justice and discharging a firearm in
[1:55] Speaker 2: a built-up area. So he wants to determine whether these
[2:01] Speaker 2: witnesses were indeed where the state alleges that they were.
[2:04] Speaker 2: He wants employment records to show what time they were
[2:09] Speaker 2: at work, what time they left work. He wants residential
[2:12] Speaker 2: addresses to see if there are you know, around the
[2:17] Speaker 2: area where the incident took place. This information has not
[2:19] Speaker 2: been disclosed to him by the state. So he's basically
[2:22] Speaker 2: saying this is, you know, is prejudicing him in terms
[2:26] Speaker 2: of his fair rights, his rights rather to a fair trial.
[2:32] Speaker 2: And it's hampering his ability to put up a defense
[2:37] Speaker 2: on the charges. We know that they are preparing towards
[2:41] Speaker 2: a pretrial trial. We are not there yet, obviously, because
[2:45] Speaker 2: there's still arguments about the disclosure that's been made. So
[2:50] Speaker 2: the state in its response has basically said the defense
[2:55] Speaker 2: never served them with the notice or the application itself.
[2:58] Speaker 2: So they can't respond today. They couldn't respond today. So
[3:02] Speaker 2: the case was postponed to afford the state time to
[3:06] Speaker 2: come up with an explanation as to why they have
[3:10] Speaker 2: not given full information to the defense. And then he's
[3:14] Speaker 2: gone on to make a point, Mindy, about the fact
[3:17] Speaker 2: that every time he's brought a bail application, the state
[3:20] Speaker 2: has come up with new information and just basically stating
[3:24] Speaker 2: that this shows that the state is not being open,
[3:28] Speaker 2: not playing open cards with him and trying, if you will,
[3:31] Speaker 2: to frustrate him and keep him behind bars, essentially.
[3:36] Speaker 1: What's the situation with bail now? I know he's brought
[3:39] Speaker 1: like several applications. He's lost all of them. Has he
[3:42] Speaker 1: just kind of accepted that he's going to stick around
[3:45] Speaker 1: in Chukchi until this matter goes to trial?
[3:49] Speaker 2: I don't think he has much of a choice. I mean,
[3:51] Speaker 2: he's brought three bail applications that were all heard by
[3:54] Speaker 2: the same judge, all of the magistrate rather, all of
[3:58] Speaker 2: them on different facts which the magistrate then found were
[4:02] Speaker 2: not new facts. This all had to do with his
[4:05] Speaker 2: address If you recall, Mandy, when he was initially arrested,
[4:09] Speaker 2: Ban Mokhozi was cooperating with, not really cooperating with police.
[4:17] Speaker 2: They had said that they would not oppose bail. The
[4:19] Speaker 2: state was not willing to let him out on bail,
[4:23] Speaker 2: to not oppose his bail. But then he started playing
[4:26] Speaker 2: hide and seek with the investigating officer, would not answer
[4:29] Speaker 2: the phone, would not say where he is, would not
[4:31] Speaker 2: give information. his proper addresses, he ended up giving three
[4:35] Speaker 2: addresses which were all found to not be true. They
[4:38] Speaker 2: could not be verified. And then he came and said, no,
[4:41] Speaker 2: he has new facts. And then those new facts, he
[4:44] Speaker 2: couldn't provide a statement that showed a proof of address.
[4:47] Speaker 2: I mean, it was the most astonishing thing where in court,
[4:51] Speaker 2: the lawyer had to go on the phone, cell phone
[4:54] Speaker 2: to look for a bank statement to verify the address.
[4:59] Speaker 2: They failed in that bit. They came the third bit
[5:02] Speaker 2: at the magistrate's court was when he used an address
[5:05] Speaker 2: that he said he used when he attended the Madlanga Commission,
[5:09] Speaker 2: which was in Johannesburg. And the question was, why didn't
[5:13] Speaker 2: you provide this address before? And there was no response
[5:16] Speaker 2: to that. And then he went on to say, no,
[5:19] Speaker 2: his wife has now gotten a new lease, so he's
[5:23] Speaker 2: got a new address that can be verified. But the
[5:26] Speaker 2: magistrate argued that you've never lived in this place, so
[5:28] Speaker 2: this cannot be said to be addressed because this place
[5:31] Speaker 2: your family moved in while you were in prison. So
[5:34] Speaker 2: that failed at the magistrate's court. He went to the
[5:36] Speaker 2: high court. The high court was like, you know what?
[5:39] Speaker 2: There's no reason for us to interfere in this. You
[5:41] Speaker 2: did not provide. You were not truthful. And maybe you
[5:45] Speaker 2: and I both know if you want to get bail,
[5:47] Speaker 2: if you're arrested, the first thing the investigator officer has
[5:50] Speaker 2: to do Verify it's your home address. If they can't
[5:52] Speaker 2: do that, you will not get bail. So that's where
[5:54] Speaker 2: we are.
[5:55] Speaker 1: Fascinating stuff, Demokato. Thank you very much, Demokato Lashoro, EWN
[5:59] Speaker 1: reporter in court with Brian Makoti on the WhatsApp line.
[6:03] Speaker 1: Marcel Ropoto says, feels like Brian Makoti, Brown, Brian, Brown Makoti,
[6:09] Speaker 1: is the sacrificial lamb. Where is the five big cartel?
[6:13] Speaker 1: He's just the ice boy. He does seem like the intermediary,
[6:16] Speaker 1: the guy who is holding everything together. So do you
[6:18] Speaker 1: reckon he's just the fall guy or do you think
[6:21] Speaker 1: this is the right way for authorities to be going?
