[0:00] Speaker 1: So let's start in the courts. Gemotso Modise, EWN reporter,
[0:03] Speaker 1: is there for us. Gemotso, good afternoon to you. We
[0:06] Speaker 1: are waiting for this businessman to appear. What are the
[0:09] Speaker 1: police saying so far?
[0:12] Speaker 2: Good afternoon, Mandy. Well, we know that the 49-year-old man
[0:14] Speaker 2: that was arrested yesterday at the Aratambo International Airport is
[0:18] Speaker 2: going to be appearing sometime today at the Pretoria Magistrates Court.
[0:22] Speaker 2: Police have confirmed that he's arrested in connection with failing
[0:26] Speaker 2: to appear before the Malanga Commission. as a warrant for
[0:28] Speaker 2: his arrest had been issued. We also know that he's
[0:32] Speaker 2: been investigated for fraud and corruption at the Ngakamudurimulema municipality
[0:37] Speaker 2: in the northwest. And so he's got links and ties
[0:40] Speaker 2: to the northwest as well. And we're waiting for his
[0:43] Speaker 2: appearance any moment now. What we know about his arrest
[0:47] Speaker 2: is that police say they had been looking for him
[0:52] Speaker 2: for a while and he was evasive, he wasn't cooperating properly.
[0:54] Speaker 2: And that's why they've decided to arrest him at the
[0:56] Speaker 2: Orotamu International Airport just before he boarded a flight or
[1:00] Speaker 2: was meant to board a flight, an international flight with
[1:03] Speaker 2: his family.
[1:04] Speaker 1: Do we know where he was going, if he was
[1:06] Speaker 1: intending to come back, why he was going, any of
[1:09] Speaker 1: that detail?
[1:11] Speaker 2: The police haven't told us where he was going. In fact,
[1:14] Speaker 2: police spokesperson Aflenda Mate says that his lawyers will be
[1:18] Speaker 2: the ones to dive out to the court about where
[1:20] Speaker 2: he was going. What we know, though, is that he
[1:23] Speaker 2: had a return ticket booked And so Mate has said
[1:27] Speaker 2: that they have no evidence that he was fleeing from
[1:30] Speaker 2: the country because it seems from what they know about
[1:33] Speaker 2: his trip, he was planning to return to South Africa
[1:36] Speaker 2: with his family. But the details around his trip, how
[1:39] Speaker 2: long he was going to be away for, we know
[1:42] Speaker 2: very little about that. All we know is that police
[1:45] Speaker 2: are categorizing this as a Schedule 1 offense. And so
[1:50] Speaker 2: it's yet to be seen how the state will be
[1:51] Speaker 2: addressing this. But, of course, if the state does oppose
[1:55] Speaker 2: his release on bail, then they'll have to give reasons
[1:58] Speaker 2: for why he should not be released on bail, as
[2:01] Speaker 2: the schedule against the 49-year-old is a Schedule 1 offense.
[2:05] Speaker 1: Do we know what the actual charge is?
[2:08] Speaker 2: So they're treating this charge as contempt of court. That's
[2:12] Speaker 2: what Plenda Maté has said to us as the media.
[2:16] Speaker 2: Of course, We haven't seen this before, particularly when it
[2:19] Speaker 2: comes to the Majanga Commission. But I also don't have memory, Mandy,
[2:22] Speaker 2: of this happening before.
[2:23] Speaker 1: Normally they pick somebody up on a different charge, like
[2:26] Speaker 1: an insurance fraud or something. So it's interesting what the
[2:31] Speaker 1: actual charge is.
[2:32] Speaker 2: Yes. All we know from police at this stage is
[2:35] Speaker 2: that they are treating it as contempt of court. And
[2:37] Speaker 2: the reason that police are giving it is because the
[2:41] Speaker 2: Majanga Commission is a judicial commission of inquiry. And so
[2:44] Speaker 2: he's being treated or the process rather and the commission
[2:47] Speaker 2: rather is being treated as contempt. would be treated like
[2:50] Speaker 2: in the high court. And so his failure to appear
[2:53] Speaker 2: before the commission is then being considered contempt of court. However,
[2:57] Speaker 2: the details, I think, will be given further as soon
[3:00] Speaker 2: as the suspect appears in the magistrate's court any moment now.
[3:03] Speaker 1: We'll take that live as it happens. Thank you very much.
[3:06] Speaker 1: Let's have a listen to what the police spokesperson, Atlende Maite,
[3:11] Speaker 1: has had to say.
[3:12] Speaker 3: He was flagged by our cold case unit. on charges
[3:17] Speaker 3: of fraud and corruption that are under investigation that relate
[3:22] Speaker 3: to the Ngakamu de Rimulema District Municipality in the Northwest Province.
[3:28] Speaker 3: And so the team was alerted that this particular individual
[3:32] Speaker 3: was flying out of the country.
[3:34] Speaker 1: They flagged him.
[3:35] Speaker 3: They alerted the cold case unit. The cold case unit
[3:38] Speaker 3: then alerted the commission's recommendations task team because they have
[3:42] Speaker 3: been working closely. We know that he is facing a
[3:46] Speaker 3: charge of failure to appear before the Matanga Commission of Inquiry.
[3:53] Speaker 3: You will know that the Matanga Commission of Inquiry, it
[3:57] Speaker 3: operates like a high court because it's presided by a judge. Um,
[4:01] Speaker 3: so he previously appeared and when he was required to
[4:06] Speaker 3: appear again and to provide a further documentation, um, he
[4:10] Speaker 3: fails to provide valid reasons as to why he could not, um,
[4:15] Speaker 3: appear before the Madanga commission of inquiry.
[4:18] Speaker 1: Brigadier Atlanta Mate speaking there as we wait for that businessman.
[4:23] Speaker 1: You know who he is, I'm sure. And if you
[4:25] Speaker 1: don't know, keep listening. We'll let you know soon, as
[4:27] Speaker 1: soon as he appears. Um, I wonder, can you claim
[4:30] Speaker 1: to not be a flight risk in a bail application
[4:33] Speaker 1: if you're arrested at an airport while trying to leave
[4:36] Speaker 1: the country? I suppose he could say or have to
[4:38] Speaker 1: prove that he had a business meeting. Maybe that's probably
[4:42] Speaker 1: why he bought a return flight so that he could
[4:46] Speaker 1: show that if he was arrested that he had a
[4:49] Speaker 1: return flight. So I wonder how that's going to be managed.
