## Transcript

[0:00] Speaker 1: In the Western Cape High Court, the EFF and the
[0:02] Speaker 1: African Legal Professionals Association challenging the Section 89 Impeachment Committee's
[0:07] Speaker 1: decision to rescind the appointment of advocate Tandazani Madonsela as
[0:12] Speaker 1: evidence leader. Yesterday, we heard from the applicants. Today, we're
[0:16] Speaker 1: hearing from the respondents. So the Impeachment Committee's lawyers responding,
[0:21] Speaker 1: Lindsay Dentlinger, EWN Parliamentary Reporter. is there for us. Lindsay,
[0:25] Speaker 1: afternoon to you. Take us through the arguments being made today.
[0:28] Speaker 1: Advocate Camille Prometta, I think, is arguing.
[0:32] Speaker 2: Good afternoon, Mandy. Yes, he seems to be nearing the
[0:35] Speaker 2: end of almost three hours of arguments before the court
[0:39] Speaker 2: on that recommendation of advocate Tandazani Madansela, and importantly, pointing
[0:44] Speaker 2: out to this court that, if I could say, it
[0:47] Speaker 2: was merely a recommendation. There was yet no process to
[0:52] Speaker 2: appoint him. This was part of a process to get
[0:55] Speaker 2: to that particular point. And Advocate Premit really trying to
[1:01] Speaker 2: bring home the point that the actions that Parliament took
[1:05] Speaker 2: or this committee took in this particular matter, first to
[1:08] Speaker 2: make that recommendation and then later to rescind it, it
[1:11] Speaker 2: wasn't acting on external pressures from anyone, least of all
[1:15] Speaker 2: the President, who also objected to this recommendation being made final,
[1:21] Speaker 2: saying that what the committee was doing really was to
[1:24] Speaker 2: protect the integrity of this process, that it had adopted
[1:27] Speaker 2: a higher bar than the average for determining what would
[1:33] Speaker 2: be considered a high threshold for integrity, and that all
[1:39] Speaker 2: the information that was put before it, be that from
[1:42] Speaker 2: ANC Secretary-General Fikile Mbulula, what MPs may or may not
[1:46] Speaker 2: have known when they took that initial recommendation what Advocate
[1:50] Speaker 2: Madden-Seller himself declared to the committee. All these were factors
[1:54] Speaker 2: that it has taken into account to make sure that
[1:57] Speaker 2: this process is beyond reproach and that it could not
[2:03] Speaker 2: be argued for certain what MPs did and did not
[2:07] Speaker 2: know about the extent to which Advocate Madden-Seller at the
[2:11] Speaker 2: time was consulting with the ANC on matters related to
[2:16] Speaker 2: these impeachment proceedings, Mandy.
[2:18] Speaker 1: So, Lindsay, once Advocate Camille is done, what happens then?
[2:22] Speaker 1: Is anybody else due to argue?
[2:25] Speaker 2: Well, we expect the two applicants, the EFF and the
[2:32] Speaker 2: Legal Professionals Association. It gets me so tangled with that one.
[2:39] Speaker 2: That they will be allowed to respond to the allegations
[2:44] Speaker 2: or the arguments that Advocate Premit, as I stepped out
[2:47] Speaker 2: of the courtroom, was saying that they had not followed
[2:50] Speaker 2: through on the arguments that they had raised. flip-flopped between
[2:54] Speaker 2: what they had put in their motion to the court
[2:56] Speaker 2: and their arguments to the court and subsequently their heads
[2:59] Speaker 2: of argument and to respond to that. So we do
[3:03] Speaker 2: expect proceedings to carry on into the afternoon, Mandy.
[3:07] Speaker 1: Lindsay, thank you. Lindsay Dentlinger, EWN parliamentary reporter, speaking to
[3:10] Speaker 1: us there about that application currently being heard in the
[3:14] Speaker 1: Western Cape High Court.
