[0:00] Speaker 1: So let's start in the Constitutional Court where Lindsay Dentlinger
[0:02] Speaker 1: has got the latest for us. Lindsay, good afternoon to you.
[0:06] Speaker 1: Thank you very much for your time. Take us through
[0:08] Speaker 1: that judgment today.
[0:11] Speaker 2: Good afternoon, Mandy. A very brief, more in order than
[0:14] Speaker 2: the court saying it will provide reasons for its judgment later,
[0:17] Speaker 2: but essentially overturning the ruling of the Electoral Court, which
[0:22] Speaker 2: did not find in the ANC's favor to add candidates
[0:26] Speaker 2: to its list. that it had not finally submitted before
[0:30] Speaker 2: the deadline. The Constitutional Court now allowing the ANC to
[0:33] Speaker 2: do so, saying that the IEC should do everything possible
[0:38] Speaker 2: to ensure that these 101 candidates are added to the
[0:42] Speaker 2: ballots for the six affected municipalities and that obviously the
[0:48] Speaker 2: party won't be able to add any new candidates, but
[0:53] Speaker 2: Certainly those candidates that it had uploaded and captured information
[0:57] Speaker 2: for before the deadline. But here's Judge Ramaka Matopa handing
[1:02] Speaker 2: down that brief order this morning, Mandy.
[1:04] Speaker 1: So, Lindsay, what does this now mean and what has
[1:07] Speaker 1: the reaction been from the ANC, the IEC, other parties
[1:10] Speaker 1: as well?
[1:12] Speaker 2: Well, for Kilian Belula speaking, after that judgment in the court,
[1:15] Speaker 2: it really came out guns blazing, said that the ANC
[1:19] Speaker 2: was not seeking to attack the IEC. It didn't believe
[1:23] Speaker 2: that it did so. It was really its application was
[1:26] Speaker 2: to challenge the process itself. and the rules that govern
[1:30] Speaker 2: the submission of candidates. But obviously, with a matter like this,
[1:34] Speaker 2: it became obviously very tense politically for Kilian Belula, once again,
[1:41] Speaker 2: indicating that He would seek to have the DA removed
[1:46] Speaker 2: from the government of national unity because they opposed this
[1:49] Speaker 2: matter both in the electoral court and in the constitutional
[1:52] Speaker 2: court and said that the ANC didn't need partners like
[1:56] Speaker 2: this who were working against it. And so that they
[2:00] Speaker 2: should review that relationship. The DA saying that it had
[2:04] Speaker 2: noted this threat from Fakile and Belula, but it wasn't
[2:07] Speaker 2: in the GNU just to go along with everything that
[2:11] Speaker 2: the ANC says and does. And that is focusing on
[2:14] Speaker 2: the elections. We know that the DA has said. look
[2:17] Speaker 2: to take the gap, especially in the Eastern Cape, where
[2:19] Speaker 2: the ANC has fallen short of or had fallen short
[2:22] Speaker 2: of submitting those candidates, which they will now be allowed
[2:25] Speaker 2: to include. But the DA ramped up its campaign in
[2:28] Speaker 2: the Eastern Cape by naming mayoral candidates, etc., for municipalities
[2:32] Speaker 2: like Ports and Johns and Inguza Hill, which are ANC
[2:37] Speaker 2: strongholds and thought that they could perhaps take the gap
[2:41] Speaker 2: here where the ANC was, uh, up until this morning, not, uh,
[2:45] Speaker 2: included on the ballots. Uh, and so, um, a political
[2:49] Speaker 2: fracker of possibly, uh, a brewing, um, the Africa, my
[2:53] Speaker 2: brewer movement, uh, Floyd Chivambo's outfit saying that he believed, um,
[2:58] Speaker 2: And the political parties who found themselves in a similar
[3:01] Speaker 2: position that the ANC did on August 28th should also
[3:05] Speaker 2: be accorded the same treatment. So we know that the
[3:08] Speaker 2: Electoral Court already ruled against the United Democratic... fund party.
[3:14] Speaker 2: I think they are named and they actually brought their
[3:17] Speaker 2: application on the deadline day, asking for more time to
[3:20] Speaker 2: submit their candidate list and the Electoral Commission dismissed them.
[3:24] Speaker 2: And so it remains to be seen, Mandy. We know
[3:26] Speaker 2: by the IEC's own admission, there were more than 40
[3:29] Speaker 2: parties in a similar position to the ANC when that
[3:33] Speaker 2: deadline struck. And what will happen now, whether they will
[3:36] Speaker 2: seek to approach the courts or go directly to the
[3:38] Speaker 2: IEC to try to get their candidates on the ballots
[3:42] Speaker 2: as well.
[3:43] Speaker 1: Lindsay, thank you very much. Lindsay Dentlinger, EWN parliamentary reporter
[3:46] Speaker 1: with the latest on that judgment. Let's take a listen
[3:48] Speaker 1: now to the ANC Secretary General Fikile Mbalula speaking in court.
[3:53] Speaker 3: Thank you very much, Comrade Malengi. Ladies and gentlemen of
[4:00] Speaker 3: the media, good morning to all of you. I'm standing
[4:09] Speaker 3: on the steps of the Constitution Hill. On this hill,
[4:16] Speaker 3: our people were once held in cells for demanding the
[4:21] Speaker 3: very thing that has been decided inside this building today.
[4:27] Speaker 3: One sentence on what the court has ordered, the Constitution
[4:33] Speaker 3: has spoken, and it has spoken for the people of
[4:38] Speaker 3: this country. Let me begin with thanks because this was
[4:44] Speaker 3: never the work of one office. I thank the president
[4:53] Speaker 3: of the ANC for his leadership through a hard month
[5:04] Speaker 3: and for insisting at every turn that this movement Take
[5:12] Speaker 3: the lawful road and no other. I thank the national
[5:20] Speaker 3: officials of the movement who carried this matter with patience.
[5:30] Speaker 3: Patience was not easy. Sure.
[5:35] Speaker 1: And then just after that, he said, I'm not feeling well.
[5:38] Speaker 1: And he collapsed on camera. Why do you think Fikile
[5:41] Speaker 1: Mbalula is so emotional about this? He obviously was under
[5:44] Speaker 1: enormous pressure. This could have been a massive indictment on
[5:47] Speaker 1: his leadership if the candidates hadn't been submitted. So I'm
[5:50] Speaker 1: sure he was very stressed. Maybe he's unwell, to give
[5:53] Speaker 1: him the benefits of the doubt. But you heard there,
[5:58] Speaker 1: breaking down Fikile Mbalula over this issue. What do you
[6:01] Speaker 1: make of that? What is at stake for the ANC here?
[6:05] Speaker 1: I think they would have been quite relieved. and quite
[6:08] Speaker 1: stressed about this decision. So much reaction to it as well.
[6:11] Speaker 1: We'll bring you some of that, the ANC winning in
[6:15] Speaker 1: the Constitutional Court today.
