## Transcript

[0:00] Speaker 1: Also in court today in the Randberg Magistrates Court, Shadrach Sabir,
[0:02] Speaker 1: the former Deputy National Police Commissioner's former, his bail application
[0:08] Speaker 1: finally coming to an end. It's now been postponed for judgment,
[0:12] Speaker 1: and it's been quite a lengthy bail application, quite a
[0:15] Speaker 1: lot of detail coming out. Alpha Ramashwana, EWN reporter, has
[0:19] Speaker 1: been in court for us. He joins us now in
[0:21] Speaker 1: our Joburg studio. Alpha, thank you very much for coming in.
[0:25] Speaker 1: So you've been covering this whole thing. How do you
[0:28] Speaker 1: now reflect on what the evidence is that has emerged?
[0:32] Speaker 2: Yeah, good afternoon, Mandy. I think this was one of
[0:34] Speaker 2: the longest bail applications that I've personally covered. And the
[0:39] Speaker 2: state also had a similar view because the prosecutor made
[0:42] Speaker 2: a remark today to say that they feel like they
[0:44] Speaker 2: are halfway through the trial already, given the amount of
[0:47] Speaker 2: evidence that was presented during this bail application. I mean,
[0:50] Speaker 2: Almost every single day over the past three weeks, we
[0:53] Speaker 2: had a different voice note, a different sound clip that
[0:55] Speaker 2: was played in court. Most of the clips and the
[0:58] Speaker 2: evidence that was brought in by the state was to
[1:01] Speaker 2: try and convince the court that should Shadrach Sibya be
[1:04] Speaker 2: granted bail, he could possibly try to interfere with this
[1:07] Speaker 2: case or intimidate witnesses. I mean, they even played a clip,
[1:11] Speaker 2: a recorded phone call, where one of his friends, Azuyangwe Maumera,
[1:14] Speaker 2: is heard looking for the identity of the 18-year-old woman
[1:18] Speaker 2: who was allegedly raped by Sibiya to sit down and
[1:21] Speaker 2: talk with her. Another clip that was presented last week
[1:24] Speaker 2: was that of Shadrach Sibiya threatening Mr. M, who is
[1:28] Speaker 2: the father of the 16-year-old that he's accused of sexually grooming.
[1:31] Speaker 2: So there was a lot of evidence where Sibiya is
[1:34] Speaker 2: heard allegedly threatening to wipe out the entire family of
[1:38] Speaker 2: the 16-year-old that he's accused of sexually grooming, his friends
[1:41] Speaker 2: as well, whom the state refers to as a cabal,
[1:44] Speaker 2: threatening to... find the identities of some of the victims
[1:48] Speaker 2: and the witnesses. So really a lot of evidence that
[1:51] Speaker 2: was presented for a bail application.
[1:54] Speaker 1: So today we had the last bits being presented by
[1:58] Speaker 1: the prosecutor in the matter as well. What else has
[2:00] Speaker 1: come out that's new?
[2:02] Speaker 2: While the prosecutor today was giving their own views of
[2:05] Speaker 2: why they are objecting to Shadrach Sibia's bail application, they
[2:10] Speaker 2: believe that if Sibia is to be granted bail, he
[2:13] Speaker 2: could possibly interfere with the case and intimidate witnesses. Going
[2:17] Speaker 2: back to the sound clips and voice notes that were
[2:20] Speaker 2: presented to the court over the past three weeks, in fact,
[2:23] Speaker 2: the prosecutor says, should Sibia be granted bail, the lives
[2:27] Speaker 2: of the victims could possibly be in jeopardy. The 18-year-old
[2:31] Speaker 2: and the 16-year-old are in witness protection as we speak.
[2:33] Speaker 2: We've heard them through affidavits submitted to the court saying
[2:36] Speaker 2: that they are living with suicidal thoughts and they fear
[2:40] Speaker 2: for their lives after the incidents. Let's take a listen
[2:42] Speaker 2: to what Prosecutor Velile Makasana had to say about Chadwick
[2:46] Speaker 2: Xavier's bail application today.
[2:48] Speaker 3: His conduct, and this is what we're busy with, Your
[2:51] Speaker 3: Sheep here, his conduct has a direct bearing on this
[2:54] Speaker 3: bail application. I'm saying this, Your Sheep, because I placed
[2:59] Speaker 3: on record this study that now the state is in
[3:02] Speaker 3: possession of statements that the cell phones that he was
[3:05] Speaker 3: using around the time of commission of this offence were
[3:08] Speaker 3: wiped out on his instructions. That will become very much
[3:12] Speaker 3: clear during the trial. His past conduct casts light on
[3:17] Speaker 3: what the applicant can do in future. If, being a
[3:20] Speaker 3: police officer, he managed to destroy evidence fully aware that
[3:23] Speaker 3: it was sought, then one should not wonder about his capabilities.
[3:28] Speaker 3: It is further submitted that this act of destroying evidence
[3:31] Speaker 3: amounted to a clear interference with the investigations.
[3:35] Speaker 1: So there we have the prosecutor in the matter, Shadrach
[3:37] Speaker 1: Sabir's bail application finally coming to a conclusion, being postponed
[3:42] Speaker 1: for judgment. So much detail coming out there. Where does
[3:45] Speaker 1: it leave you? What are your thoughts on this case
[3:48] Speaker 1: against Shadrach Sabir? Is it a stitch-up? Is he being
[3:50] Speaker 1: set up? Or do you believe the evidence that has
[3:53] Speaker 1: been read into the record so far about what the
[3:57] Speaker 1: state is alleging against him?
