Our membership of the European Union, together with the Human Rights act and devolution, have all increased the influence of judges and, so some would argue, brought them into the political arena. Some indeed have suggested that non-elected judges have begun to usurp the role of politicians. How are our judges chosen, and are reforms needed in the system for selecting judges? And how ought the roles of politicians and judges be demarcated in a modern representative democracy?
